finally got an eviction date! few q's re this!

We finally have got an eviction date for the old house which is 20th August at 12pm. I assume by this the mortgage company then have possession of the house (even though we returned the keys to them months ago and we moved out last December!).

Does this mean then that the secured loan now becomes unsecured because we no longer 'own' the house? If this is the case should I advise Black Horse of this?

Also, should I email the OR and advise them the house has now been repossessed? And do I inform the mortgage company I am bankrupt?

One last thing (for now!) if we were to move house again, obviously we would inform the OR but does the Insolvency website get updated to reflect the new address?

    Hi

    Now that the house has been officially repossessed it means that you are no longer liable for electric, gas, council tax etc from this date. The house will now be sold or auctioned and then they will let you know the shortfall (this could take months)
    After I found out how much my shortfall was I took advice and went BR.
    But if you have already included this in the BR then the OR should deal with it. It does no harm to keep the OR up to date on any changes.

  • Sorry PP, i cant offer much advice, I am sure I read somewhere that this is the case, your shortfall and unsecured loan is now included.

    We are waiting for our repo at the mo, i for one cant wait as we moved out mid june, i can then stop worrying about it.

    My OH and myself went bankrupt in oct 2006, our home was repossessed in Jan 2007. we are now settled in a lovely house in a lovely rural location, and thought everything was fine, that was untill the 2nd mortgagee started bugging us for the shortfall in the repossessed property! despite the fact that it was listed in our bankruptcy has not made a scrap of difference to them, they still say we're liable for it, even though we were told before our bankruptcy that any shortfall and arrears on the mortgage accounts would no longer be our responsibility once we'd declared ourselves bankrupt! I've written to RTLU and am going to let them deal with it, sometimes think they're just trying it on! :o

    Can I be nosey and ask how long it was between stopping payments on your mortgage and repossession? I'm now 8 months in arrears and still no eviction notice, which I desperately need to happen to apply for council housing.

    we moved 9 months ago and that is when we missed the first payment. we sent the keys back a few months ago but they still took us to court etc so i don;t know if that helped speed things up.

    the posession hearing was in may (the week after we went BR) we never attended and didnt complete any of the forms requested by the court.

    an eviction date (even though we were already) out was granted by the court in july for 20th august.

    we also never replied to any letters or made contact except for sending them the keys.
