Last year I recieved a county court summons. I intended to defend the case, but got very mixed up with the paper work etc.and a judgement was made against me.
I paid sixty pounds to have it waived, but due to ignorance, was waiting for forms to come , for me to put my side of the story.
Soon after, I recieved another CCJ in the applicants favour.
I then recieved a letter from a court debt company staing they were going to come around and seize "goods" to the value" I paniced and reached an agreement through them, with the appplicants, to pay. over an agreed time.
I am in the process of persuing the applicants through court.
How can I get this CCj removed??
Thank you
With regards to a set aside notice you would need to demonstrate to the court that on the balance of probability that you would of been able to adequately defended the original claim, however as you have admitted liability by default the court will see no legal reasoning for an application to set aside (unless the original judgement was unlawfully issued)
Also if you admit to having received the claim form but not actioned your defence in the required time the court will have even less sympathy with you as form their perspective you have already been given the opportunity to defend the claim but didn’t:rolleyes: It’s hard enough remembering my opinions - without remembering my reasons for them :rolleyes:0 -
yes there is know way you can get it removed as by paying you have admitted the claim to get it set asside is not realy an option your best course would be to pay it off and then get it marked as settled it will be removed in 6 years ,but marked as settled over time it will improve your rateing as lenders will see it is an old settled cj0
