The Data Protection Act, 1998, gives you the right to request, from any organisation, everything that they hold on file about you.
To do this, you would need to submit a 'Subject Access Request', or SAR, to that organisation, along with the Statutory Maximum Fee of £10.
On receipt of your request, plus the £10 Stat fee, that organisation then has 40 days in which to provide you with everything that they hold about you.
This would include copies of all statements and a copy of the original 'signed' consumer credit agreement, relating to the account.
For more information about SAR requests, have a look at:
http://www.ico.gov.uk/what_we_cover/data_protection/your_rights/how_to_access_information.aspx
It is an excellent way of getting all details and, providing they exist, the 'statements that you have been asking them for.
It is not intended as an alternative to a cca request, but the lack of information, for example no cca or missing/doctored statements would have the same effect in rendering the agreement 'unenforceable'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
