Do I have to attend court for the redetermination hearing? there is nothing about attending in the letter that has arrived regarding the date that has been set.
Applying for a redetermination hasn't given me as much time as I'd hoped, date is set for less than months time.
Thanks.

I would attend if it was me.

Hi
Yes you should always attend a hearing.
Did you ask for the redetermination? Why do you need more than a month?

Because I don't know what the outcome will be and I can't afford to pay them anything other than a token offer and they were asking for £95 a month. Yes I asked for the redetermination, but only to bide me more time.
I needed time to try and find alternative accomodation and sort out my other debts ready for going BR, but this hasn't gone according to plan and I'm no further down the line with this.
Oh well, I'll just have to turn up and hope all goes well. Should I plan on taking anything with me?0 -
Did you make a token offer? It is all based on your financial statement, turn up to court with a financial statement showing that you can only afford £1 or whatever it is you can afford. The only reason the court would have set £95 was because your surplus would have shown that or either that your expenditure was too high, you could pop up your soa on here for an opinion.
Also make sure you list all of your other creditors too

I can't understand them setting it at £95 if they looked at my SOA. My mortgage payment alone cannot be met by my income never mind all the basic bills and food etc.
I listed my other creditors, all of which have accepted a token offer. I can only presume it is because the debt is a large sum (£22k I think)
I sent another SOA with my application for a redetermination, is it worth taking another along with me on the day?0 -
Yes take it along for good measure. Good Luck!

Who is your creditor? They could potentially be looking at going for a charging order as they refused your initial offer...
