P11D - date query

in Cutting tax
Hi all, hope you can help clarify a query I have.
To keep as brief as poss.
I travel over 10k business mile per annum in my own car. 40p for 1st 10k, 25p thereafter.
I keep my own log as the company system does not validate the mileage.
I've just been told that I claimed too many miles @40p for the last tax year.
I have queried this and have been told that there are 2 claims which were processed during the 08/09 tax year (logged and paid), although the mileage was for trips made in March 08 (outside the tax year). They were not, therefore, included in my log, although the company maintain that because they were settled in the tax year then they are included and I have therefore overclaimed at 40p.
does that make sense?!
I honestly believe that the claims and mileage should relate to the date of journeys and not the date of claims.
Is anybody able to clarify please? Supporting documentation would be a bonus (spent 3 hours today on HMRC website, best I could find was the tax table "40pence per mile for the first 10000 business miles of the tax year")
Any help appreciated.
Thanks in advance,
Allan

Hi Allan
I recently worked processing pay through the HMRC system, so can not validate other than "what i did or was taught to do".
All the mileage i had to process went through on the date that the claim was submitted not when the journey occured. We just had to store them and then amalgamate/process before the end of the tax year.
If you want further clarification you can phone your tax office which your employer should be able to give you details of. They may also come to an "arrangement re your mileage" (Have seen this done)
Good luck0 -
agree with Big aki,
it is the date the claim was paid that counts,
you account for income on your tax return when you get it not when you incur the eligiblity to claim it0 -
Thanks for the responses. It has been referred to a tax manager for clarification, although it looks like I had misunderstood and it is indeed the date of settlement is the key date!
Does this mean I can stop claiming after my first 10k this year, and submit it all for claiming on 6th April 2010 at 40p?! (I know I wont hit 10k next year so it wont be an in issue then!)... :rolleyes:0
