Note on credit file re ccj?

Hi

I recently received a CCJ on a debt I knew nothing about. The correspondance was sent to my previous address (and in my maiden name). I have been told I can put a note on my file about this. Can anyone tell me how I go about doing this?

Thanx

  • Hi

If you have just got the CCJ and you dont recognise the debt then you could apply to set it aside but you must have grounds to do so. Creditors can now go for a ccj providing they have notified you at the last known address so if the debt did belong to you then the company are within their rights.

Do you recognise the debt at all?

You cant just put a note on your credit file unfortunately, you need to deal with the ccj by either paying it or if you dont acknowledge it then to set it aside.

If successful in setting a ccj aside then it would put you and the creditor back into the posn prior to the claim being issued and then if they were to issue it again you could defend it.

If you do recognise the debt then you need to pay it, I would imagine you have received a judgment in default which will mean the creditor has set the rate of payment by instalments or in full. If this is unaffordable to you then you can apply to vary the order and ask for payments to be set at a rate you can afford based on your income and expenditure.

Give me a shout if you want any further information
