so my x isnt happy about how much csa he got to pay , he taking me court for more acess (i gave him access but he wants his own terms after 11 years)can he bring csa payments up?0

We have been told that we can go to the CSA but she can refuse their instruction

Access has nothing to do with the CSA case and vice versa. We have been told that they have to be dealt with seperately. Hope that helps.

Rubbish. If the court order is more than 13 months old you can insist on the CSA assessment taking precedence.0 -
thanks dancing yes kind of we agreed medation i broke my foot in 3 palces so cancelled, and reaaraged (with his knolleged for septmeber) but went away 4 3 nights and game home to a court order for 20 th , rang solicter who was trying to get hold of his soliceter, turns out a week later he decided he gonna repersent hislef and he wrote to court topostpone it as ive havent any legal advice or legal aid sorted but i rang today no news and his helper says get childcare your probly going thursaday as we havent heard from court for passpoement what happens !!!!ing myself and hurt, do i have to go without solicter also can i kinda of be done?(sox for spelling im trying )0

Thats the thing as we are both too bloody soft for our own good we didn't want to do this as any decrease is bound to affect the children:rolleyes:, our concern didn't get us any appreciation from her though.....still not enough for her. She has said and i think she actually believes that she can ruin us.

You need to ring a local solicitor first thing in the morning to find out what is going on. Ask them when you ring up for a free initial consultation and read them the letter you have.
I am sure (although not certain) that maintenance has nothing to do with access. You don't have to go to court without a solicitor and I would strongly advise against it. Do you qualify for legal aid?:rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::rotfl:0 -
So for arguments sake, she gets the assessment and decides that its not enough (sorry but nothing is enough:rotfl:) she then has to take us to court to get more money or she can't take us to court as the court won't override the csa calculation?

Except for in exceptional circumstances ( i.e the NRP is earning a lot of money ) the PWC would get no redress from the courts. The courts do not have the legal right to over ride a CSA assessment.
Even if the NRP is earning mega bucks i think the PWC would struggle to get a judgement. Get that court order torn up and start paying what you should be. That will teach the greedy biatch.0
