Parking ticket.

Hi,
i was made bankrupt last week, but today recived letter regarding parking ticket earlyer in the year which to be honest i forgot about and put to one side with everything else i could not afford to pay, my question is do i have to pay it as i have read several different things, It was given out by a trafic warden working for the local council and has now been passed to a balif, I have read that as it has been issued by the council it is a dept and can be added to bankruptcy list? has anyone any info on this?
I have rang insolvency helpline and they did not know, i have rang o.r office and at first they said no but then said they was not sure after i had stated what i had read, but as of yet I have not spoke to the person in charge of my bankruptcy as they were not available, they also said i should mention it at my interview which is wednesday.
hopefully someone can put a close on this and help me with some info.

john

Well, once they have read their own manual then they should be able to tell you this.

Nearly all parking fines can be included in the BR.

    http://www.insolvency.gov.uk/freedomofinformation/technical/TechnicalManual/Ch37-48/chapter40/part1/part1.htm
40.22A Penalty Charge Notices (frequently referred to as “fines”)

Fixed penalty notices or penalty charge notices issued on behalf of a local authority, including those in relation to the London congestion charge, are not fines for the purpose of section 150 of the Magistrates Act 1980. They should be treated as provable debts and will be released on discharge from bankruptcy. This is applicable to the majority of parking fines.

Local authorities make parking regulations, such as traffic regulation orders or traffic management orders and enforce parking contraventions in accordance with the law. Local Authorities were first involved in the enforcement of a limited number of parking acts by virtue of The Road Traffic Regulation Act 1984, although parking offences were still dealt with and enforcement action taken through the criminal court system.

The Road Traffic Act 1991 decriminalised further parking offences and they therefore fell to the local authority to enforce through the civil system. Further information regarding the type of parking conduct dealt with by the local authority, as opposed to parking offences dealt with by the police and criminal court system is available from the following link http://www.parking-appeals.gov.uk/RegAndLeg/RegAndLeg.htm.

Not all local authorities have the same abilities under The Road Traffic Act 1991 and each must possess a Special Parking Area Order before they commence enforcement.

If it's any help, I had a parking ticket from a warden that I included in my BR (received a couple of weeks before going BR) - never heard anything further about it, so guess they accepted it was included in the BR :)
