Stupid Question About CCJs

I'm considering bankruptcy to deal with my unsecured debts since they are totally unmanageable and it seems like I'll never been in a situation to repay them.

After trying to deal with the debt initially and even selling my house to try to deal with the debt I'm afraid to say I dropped of the radar mainly to get away from the harrassment.

I'm assuming that a DCA can issue a CCJ at your last known address if you move without telling them your new address.

So my question is why haven't the DCAs issued loads of CCJ at my last known address?

Is it just a case of them not wishing to spend money on court fees that they may never get back?

    Yes, thats exactly it !

    If, what they know of your circumstances, there is not much to be gained by going to court then they feel they have far more chance of being paid by ringing you at all hours bullying you in to paying money you cant afford or sending lots of threatening letters saying what they MAY do.

    They rely on people not understanding their rights / the system.

  • I know that I ran up the debt but my circumstances changed so that I could no longer work.

    I was getting a lot of really rude phonecalls from the DCAs and when they started making threats and making my partner feel guilty for debt that was nothing to do with her, I had enough.

    It seems to me that the DCA think they can do whatever the hell they like and make people's lives a misery just to try and squeeze some more cash out of them. That's why I decided to stop dealing with them and just drop off the radar.

    If I had the money I would repay the debt. But I don't and I'm never likely to be in that situation so bankruptcy looms.

    One thing I have heard about though is Statute Barred debts that are over 6 years old. If I stay off the radar a bit longer does that mean the debts are not legally enforceable?

    Is there an issue with statue barring if you moved and didn't communicate your new address?

    I'm so confused and desperate right now. I just want to get on with my life and it seems like bankruptcy is the only option. Pretty drastic option though. :(

    Debt get statute barred after 6 years of not acknowledging them. If they find you and you admit they're your debts the clock start ticking all over again.

  • AS FYP said debts are statute barred after 6 years providing you dont pay or admit in writing to them however if a CCJ was obtained within the 6 years then the statute barred period doesnt exist, best check your credit file and if you are close to the 6 years then yeah keep your head down but tbh bankruptcy will put an end to it all once and for all. Drastic yes, but come join the club...... We are all good people who made the decision to move on without the burden of overwhelming debts.
