Abbey Bank cleared my account! HELP!!

I have an account with the abbey national. Whilst on holiday I checked my online account and found that £690 had been withdrawn from my account. This left me at my limit (and now with a small amount of holiday money) I found out that a cheque had went into my account for £1027.24, a mistake the bank had not informed me about. So they took it upon themselves to withdrawn as much of this as possible (£690) and leave me with nothing in my account. I had booked a hire car for my holiday and it was costing around £300 and this has been taken from my account as i had the money in the account when it was book. So now i'm in the red in my account.
A little good news tho, i had applied for an extended overdraft and i got an extra £400. HOWEVER, i checked my online account again and the bank have taken a further £337.24 (the remainer of the cheque that wasnt mine)

I am wondering if this has ever happed to anyone before?
Is this legal what Abbey National have done?

If anyone has any experience or advice on this then i'd be very grateful.

  • Im mot an expert by any stretch but just to clarify Abbey paid a cheque into your account so your balance increased by £1027.24 which you didn't query and spent the money and then they have taken it back?
    Sorry if that sounds harsh but I would certainly notice if my balance suddenly increased by that amount.

    You'd get a better response on the bank forums.

    Just to get this straight- somebody paid money into your account not intended for you. This money is not yours. They took it back as they can do but you had spent it and left you with nothing. Lesson learned presuming this isn't trolling.

    I think he actually means the cheque was actually cashed *from* his account (i.e. the money was withdrawn). If I'm reading it correctly, he didn't have the full amount, so they withdrew his balance first of all (690 quid), then followed it up with a bit more when he got the extended overdraft.

    I could of course be wrong though.

    Although I'm slightly confused as to how the cheque was a 'mistake' - you either wrote the cheque or you didn't...
