Qualifying Child

Hopefully this should be a straight forward question, with a straight forward answer.....but knowing the CSA rules, it probably isn't !!
I am Parent with care, claiming child maintenance from NRP
NRP also has an 18 year old child live with him.
Therefore maintenance payments to me reduced - until child with him reached 19 - said the csa.
Then CSA changed their minds and said my payments would not increase as child live with him is still a qualifying child until 1st Sept following its 19th birthday - so could be until virtually 20.
Friend had her child maintenance stopped the day her child (still at school) became 19
CSA told her, day child turns 19, no longer a qualifying child.
Does this mean maintenance stop on the day child turn 19, but maintenance payments will continue to be reduced in respect of a child living with maintenance paying parent for up to a year after child turns 19 ?
Seems completely illogical to have two completely contradictory rules re age of Qualifying Child.
But I wouldn't be in the least surprised.:cool:

Which means that my friend was told a complete load of lies by the CSA then.
The NRP stopped all payment the day the child turned 19, when mother contacted csa they confirmed this was correct. She even spoke to a supervisor who again confirmed that even though child at school once he was 19 maintenence ends.
Presumably it will now be too late to appeal - which means she has lost out on hundreds if not thousands, and I know she is really struggling financially.:cool:

But you are not talking about two qualifying children - you are talking about a qualifying child (in your household, the one you get maintenance for), and a relevant other child (who lives in the NRPs household, and causes a reduction in maintenance).
There are different rules concerning end dates - you have been advised correctly, & your friend was advised correctly.0 -

You (Lil2002) are saying there are 2 different definitions of a qualifying child - both means parent with care gets worse end of the deal financially.

The rules are the frist Monday following the 19th Birthday. You are confusing September with the cease date for students who dont return to higher education.0 -

Sorry, I am not confusing the dates, these are the exact dates the CSA told me.
In my case 'child' with father turned 19 nearly a year before 1st sept. CSA said while his father received Child Benefit he still counted as a relevant other child.
But apparently if child had been with me, he would not have counted as a qualifying child from the day of his birthday - per CSA and Lil2002 above0 -
I would ask them for the the legal refernece to this. Yes a ROC is dependant on the CB being in payment but for the purpose of the legislation a child whether a qc or a roc ceases at 19 years old.
Hving looked at the cb website CB is paid aged between 16 and 19 - up to 20 in some cases - and is in relevant education or training The up to 20 in somecase is when the child has special needs.0 -
No, what I said, and am saying is that there is legislation regarding QC's, and legislation regarding ROC's - they are treated differently. You can say that there are different definitions of a child, but (believe it or not :rotfl:) the terms used ( QC/ROC) are important. A child in an NRP's household is a "relevant other child", not a qualifying child.Ah !
