Vicki,
I think it sounds fine. I would also..
- check that the income and expenditure matches any activity they may see on your account, because if there is a mismatch, they will query it.
- ask them to confirm that court action is not proceeding at this time
- say you'd be oblidged if they could reply within 7 days, because obviously this is a matter of great concern to you
- get a proof of posting receipt when you send it.
Good luck,

dont worry about it to much i doubt if it goes to court make a token payment offer which the court will accept ,if the dca will not accept then thats there problem dont enter in to anything you can not stick too and dont borrow in order to pay the debt dca would have you sell your grannie ,contact natwest say what you will pay and send it direct to them i wouldnt bother with dca etc0

Your letter sounds spot on and I hope that does the trick. I can't offer too much advice as I am not an expert on debt or debt management but I would advise you to take a look at the Student Forum on this site. Someone there called robhammond is advising students on how to apply for a grant, formerly known as the hardship grant. I don't know if this would be of any help to you but it is worth a look.
Good luck.0 -
Are there any benefits you could claim at all? I remember when I was a student I used to get housing benefit, although that was a long time ago. And my other half was able to claim a one-off hardship grant.0

thats the struggle .. can't claim any benefits at all - partly because i live with my partner who works.
tried to claim JSA not so long ago (as i switched my studies to part-time) but couldn't even do this as the uni still have me on their system as a full time student so i had no 'proof' of part time status.
being post graduate too, i dont think there is much support out there at all - i self funded the course to begin with
Plus as i'm so close to finishing i'm hoping to begin working very soon anyway0 -
Big hugs to you.
that letter looks great.
they cannot take what you just do not have i guess they will be laughed out of courtDFW nerd club number 039

Another angle to look at.
How much of the money you owe on your account with Natwest is bank charges? Would it be worth claiming all these back?

Aww cheer up hun, it's all mind games with these c~n*s.
You may not know that a debt collection agency has a responsibility to avoid court action and they cannot turn down any payment offer you make, no matter how small it is. You don't have to give them your SoA, however it might look bad if you don't. If this does go to court and the court sees they turned down your offer, they will not at all grant an order or judgement in favour of the DCA, provided you're not p!ssing away your money, which obviously you're not.
They are making empty threats and you said they have already turned down your first payment offer. Don't panic, this is just how these people do business. Don't take it personal, and writing letters is always the best way to go as what can't speak can't lie. Don't phone them (and especially not on their 0870 numbers!! https://www.saynoto0870.com)
You might want to spend £0.96 getting this letter sent recorded delivery for your own security so if they don't accept this payment offer and do try any court action, it will backfire on them. Also take a photocopy of your SoA, as I know some DCA's will say they've "lost" it and ask for another one and then compare the two to see if you're telling porky pies (which again obviously you're not).
You can also deal directly with NatWest and make payments to them, which again they can't refuse and the DCA can do nothing about - as again the court would see your goodwill and token payments. Judges are real people too you know, they won't put you in prison for being poor  I think you'll find most judges a million times more sympathetic to the individual than a DCA!
It will be handy to find out if the DCA are simply collecting on behalf of NatWest or whether they have actually purchased the debt from them. You can request this information from them with a £1 statutory fee under the Consumer Credit Act 1974, and also request the original credit agreement and statement of account. A lot of DCA's will fall over on a technicality at this point if they've messed up and they might even stop chasing you if they know they can't - but don't count on it. But, worth a shot.
As Kevicho said, it might be worth reclaiming any bank charges you might have as this might be more than the debt they are chasing you for and then you can take THEM to court
(as I am doing :j)
Anyway, don't worry - it's all mind games but you've got a new secret weapon :money:
Chin up
