Mortgage Additional Borrowing Query

In September 2005 I took a £83,000 joint mortgage out with my partner on our 2nd home. Not long after I was made redundant and went onto Incapacity Benefit through illness and then in May 2006 me and my partner seperated although I stayed in the house. I had accumulated some debts in the time since being made redundant and as paying them was a struggle now on my own I contacted my mortgage company to see if I could have extra borrowing in order to clear my other debts, Immediatley I was told I was entitled to a further £13,000, so I requested the whole sum to clear my debts and give me a cushion to live on.

Even though my mortgage was a joint policy (my ex partner was not took off the deeds, and is still a joint policy), not once did the mortgage company request her permission, be it via verbal or letter or request any signature

So basically I was borrowed a further £13,000 whilst out of work, on incapacity benefit for depression and without consent of the joint owner

Do I have any claim about being mis-sold this additional borrowing? I was not in the right frame of mind at the time to be borrowing such large sums and wasnt in a position to pay them back.

    Is this a genuine or a wind up? The only person with a complaint here is your ex-partner. Against you.

    Take responsibility for YOUR actions.

    It is more likely than not that the terms and conditions allow either borrower to arrange the additional funds.
