Repayment of tax credits from yr end 2008

    Hi all and thanks so much for your replies so far.
    Well I got into the loft and found that they originally asked for the repayment in January 2007. (SORRY THIS IS A LITTLE LONGWINDED):rolleyes:
    It says (on the Jan 07 award notice) :
    OVERPAYMENT
    up to April 2006 £1018.71
    From this award period -£53.16
    Amount overpaid - £1071.87

    Of this:
    £482.46 already collected back from you by reducing payments
    £536.25 is due from you now. We will tell you seperately how to pay.
    £53.16 is still to be confirmed as overpaid.


    At the time I phoned them and they said that as it was due to change in circumstances that the £536.25 would be collected from future awards.

    Then on the August 2007 award letter it says:
    OVERPAYMENT
    Up to 5th April 2006 - £482.46
    From this Award period - £53.16
    Amount overpaid - £535.62

    Of this:
    £482.46 has already been collected by reduced payments
    £53.16 is due from you now.


    It has not mentioned this in any future award letters. The reason the award kept changing is because after our house was repossessed I lost y job and my husband and I temporarily seperated so there was alot of messing around with incomings etc.

    Befoe I ring them and give them earache, any further advice or comments would be much appreciated.

    Ok, I'm not an expert but have had my share of dealing with TC. From the above statement all you have outstanding to pay as of Aug 2007 was £53.16. I'm surprised it hasn't been mentioned on any future award letters as I presume that this would have been taken by now? Unless your income went down to the extent that to claim it back would mean serious financial hardship.

    This is what they put on mine - due to admin error I ended up owing £700.00, did start to appeal but it was my word against thiers - writing letters goes a long way! Didn't request any back for 6mths but payments started in Jan this yr. By the time I went BR it had been paid. They actually stated it would cause me FH if they reclaimed the money so will leave it a few months.

    I know you probably have read them thru but it maybe worth checking all the pages of the following award letters again as the details are not always on the same pages?

    Also just noticed that your first post said that you had an letter regarding overpayments to 2008, but the details you posted were up to 2007. 2008 would be new tax yr, so there must be further info on your award letters?

    But looking at initially there's only £53.16 to put in, which will probably be cleared by the time you go BR - which was due year ending 2007.

    You say there is nothing on your awards you've had since then? But then you received a letter re overpayments for 2008?:confused:

    I think you should go to the CAB just to clarify what is outstanding.

    But as others have said if the repayments were asked for before your BR date then it can be included. Though I believe they can still take payments until discharge.

    If anyone can clarify that the pls do so.

    Hi everyone - just to update for anyone who has tax credits.
    It seems that although it was their mistake, they are still going to persue and I have to go thru the dispute process!!!
    The good news is that they will not stop or reduce any current payments that I receive and it could take several months to sort out so as DD said - the nearer to AD date the better as once we are discharged they cannot continue to try to get the money back.

    For everyone who has tax credits-
    These people (or rather the tax cred system) are just unbelievable. Everytime we have renewed a claim or changed circumstances etc etc etc, we have always made a point of phoning them and checking that the amounts are correct so as to avoid any mistakes or at worse an overpayment.
    It is clear that they can just do what they like and claim back whatever they want:mad:
    even if it is their own fault in the first place.
    Just everyone please beware and keep your eyes on those forms. Even if they seem old/out of date, do what I did and keep them filed somewhere as this is invaluable when going through a dispute. Also, keep a date and time record of all calls made to their office (even if it's just something simple like changing bank details etc)
    DO NOT TRUST

    I just sent in the renewal form for my WTC and CTC and got a letter back from them to say I've been overpaid by £600 (I can probably agree with this as I left it to the last minute to send back my renewal form). Get this, they say they will take it out of this year's award but keep paying me until the next tax year which will mean by that time I will have been over paid £2,000 and they will sort it all out in the next financial year. I'm going to tell them to stop the payments altogether now and make an arrangement to pay back the amount we have been overpaid to date but couldn't believe they will keep paying us which will make the situation worse each month!

    Thanks pmg - I do keep all correspondence so I know I have done everything by the book!
