Csa help and advice needed

I gave birth to my son in april 09, me and his dad are not on speaking terms at all, i have applied for maintenance via the csa, my ex does not see our son out of choice, i have tried all ways to get him to but he refuses, 7 weeks ago my ex got in touch with me to say that he had a lump sum of £324 maintenance and he was going to bring it to my house for me which works out at £36 a week, he was at this point living with a male friend, he has declared earning £229 a week which was not the amount i saw on his payslips when we were together which was £100 more per week, he did tell me that his hours at work had been cut and he was earning £130 a month less than what he had been, to my calculations that would be a drop of roughly £32 per week which would still leave him around £300 after tax and ni contributions. He has declared to the csa that he is living with a woman who has a child (not biologically his) and therefore 15% of his wages get accounted for and i get 15% of whatever is left so in effect this womans child is entitled to £35 a week and i am entitled to £29 which for a start i think is wrong as th other child is not his. when he contacted me 7 weeks ago he was still with his friend and now 7 weeks on he is living with a woman and her child, i think it is a major fabrication of the truth to try and pay as little child support as possible, i have also read in the leaflet that i got with my csa letter that if tax credits are being recieved then they are also included in the calculations, as far as my letter from the csa goes there is no mention of tax credits at all. i rang the csa this morning and mentioned the tax credits and the man i spoke to said that tax credits were not taken into account as they were from the government and nothing to do with the csa.

There are a couple of things i need to know if anyone can help:-

What proof does my ex have to provide to say that he is living with someone or do they take it on his say so?

How me getting a percentage of the tax credits works if he is in fact living with someone?

If my ex's wages are taken into account for his partners child then should his partners wages not be taken into account for my child?


I am completely at a loss with all of this and any help at all would be greatly appreciated

    Hiya

    Well CSA do count CTC if received by the NRP and a partner with other children in the house, as they are counting mine in my partners assessment. We have a reduction for 3 kids in our house (my kids from previous marriage) and he has a child living with his ex wife.

  • thats what i thought but the man i spoke to said this wasn't the case, this is my first child so i have never had dealings with the csa before, my case has been passed all around the country as nobody seemed to want to deal with it, it started in falkirk then went to portsmouth and now its with belfast and not one of the offices can give me a satisfactory answer, they all just seem to fob me off
  • Hello, I don't have the experience of your situation with regards to tax credits and claiming a partner is living with him.

    But I can say that as you are quite new to the CSA, get yourself a log book and log all calls, write down details such as names of who you spoke to, what about, etc etc, but best to do everything in writing so you have proof. Some on here will go as far as to say send your stuff recorded delivery.

    Good luck! I'm sure some more knowledgeable than me will come along with specific advice.

    Definitely send everything by recorded or registered delivery. You'd be surprised at the amount of mail the CSA say they "didn't receive":rolleyes:
    In answer to the OP's 3rd question; no his partner's wage will not be taken into consideration for assessment purposes.
