Hi all. I'm not going to go into the long, drawn out matter that led me to this point unless anyone wants specifics to help offer advice so that I don't bore everyone Lol !!
Firstly I am PWC and have a fairly amicable relationship with my ex and his wife. Have no probs with CSA now that it is all sorted and the DEO works fairly well.
I received a shock when £400 was taken out of my account which numerous calls showed was as I had been overpaid by £3000+ so the CSA decided to take back at their will. Lots of tears, stress and worry later trying to lower the amount paid back each month, I suddenly find that the amount is wrong and that for the last 2+ years the comp shows I have been getting a DEO payment and payment direct!!
Long story short, I have an apology letter with bullet points showing the catalogue of errors made by the CSA eg money taken out without my knowledge, no phone calls made, should have paid my ex out of their pot and then claimed back from me under a payment plan, the amount was an error etc etc
They are now putting me on a manual case as they have confused their comp system so much it can't cope!!!
At the bottom of the letter it states "This does not constitute a consolidatory payment and you have no grounds of appeal". (Consolidatory I was told is because they don't like to use the word compensation
).
They won't consider refunding bank charges without seeing 6 mths bank statements to prove that any charges were directly CSA fault.
I refused to send statements as why they should trawl over my accounts discussing that if I hadnt spent £20 in Tesco I may not have gone overdrawn etc etc. I had NO charges prior to the huge amount taken out and they have admitted error so as far as I am concerned that is it.
Seeings as they have listed 11 bullet points of errors and yet wont consider compensation, I can't see them refunding bank charges and if they do it wouldn't be the full amount they said??
I was just so happy all this is sorted that I was just going to accept their findings and move on but several friends have said this is soo wrong knowing how upset I was when it all happened.
Just wondered what fellow money savers think?
PLEASE don't have a go at me, I am not trying to get more money out of my ex. I am not a money grabbing PWC etc etc etc ..... yes I read all the comments on here regularly, I am just wondering what other people think as the seed of doubt is now in my mind so to speak!!!

Sorry, they took one £400 payment from me which was then the first payment of a £3000 overpayment. Obviously I phoned as soon as I realised money had been taken as it was leaving me very short that month without any warning.
This hasn't been paid back as despite taking it from me in one go, it will be given back to me at regular intervals as small payments!!!
What I meant by all sorted, is that I'm glad they just aren't taking anymore money from me and whilst I initially only wanted to change the payback amounts to smaller monthly payments and wasn't querying the alleged overpaid amount i was so shocked this was all an error and I hadnt been overpaid that I wasnt even concerned if I got the £400 back!!!
Imagine if I hadnt queried it. The system showed I would have been paying it back until Feb 2011 which would have meant well over the £3000 anyway!! CSA meanwhile earning a nice little amount. Plus my ex didnt get the £400 so I'm assuming its sitting earning interest somewhere???

Just re-read that!! In clearer terms:-
It is sorted in as much as they won't be taking further money from me and admited errors and I don't owe an overpayment.
What they won't do is compensate for the upset caused by their error in taking that money in error and without liaising with me or warning me.
I will by the end of the year have had the £400 back which is what I am happy with as it means I havent lost out as such but I had an awful month and it was the CSA complaints who suggested I have a case for compensation so I went all through that only to hit the preverbial brick wall and wondering now if I should put more pressure on.
Like Martin says with the bank charges etc, they will say no but ignore this and push on!!

If they took money out of your account in error and that in turn meant you incurred charges, then surely they should reimburse you it all (in one go) as soon as possible, just like any company would have to.August GC 10th - 10th : £200 / £70.61

If you have occurred bank charges through an error on csa part then they are liable to reimburse you the difference, especially taking money from your account without warning.
This happened to my partner but it was not the csa who took money, he had canceled a direct debit with a company and the following month they tried to take money out of his account, which he did not have in to cover, causing him to be overdrawn. He challenged this and the company apologised and reimbursed the difference.
This should also apply to the csa, they cant just go into ppls bank accounts and take what they think they should without some form of correspondence, otherwise we will all be fighting to have are wages in a wage packet,(dont care much for csa or banks)0
