Where to start.....

I have been a lurker on here for months. Many storied I have read, some have made me cry, some made me laugh and some have made me feel utterly ashamed (at myself obviously)

I was declared bankrupt (sequestrated actually I was in Scotland) on the 30th of July 2008. Too many reasons or factors to mention, many of which I am not proud of.

Depressed and with a feeling of dispair, I left the UK and moved abroad with my 2 babies. Left my family/house etc behind a tried to start a new life.

My house was repossed by the mortgage company, in negative equity and with a (massive) secured loan has now been sold.

I have made no contact with the OR. I know that obviously I will still be sequestrated.

I now feel that finally I am starting to feel better, but with this still hanging over me I can never move on. I have told NO ONE about my bankruptcy, no family, friends anything. My life to this point is one massive lie.

Now I (obvioulsy) need to contact the OR/Trustee. My question(s) really are, 1. How to I find out who it is 2. What, realistically, can I even say? 3. Am I likely to be in serious trouble for basically 'running away'

Thanks for reading......

whooooof.... already feel like a weight has lifted - and I dont even know anyone!!!

    Hi,
I can't offer any useful advice, but I didn't want to just read and run.
So hello, well done for managing to post and make a start, and I'm sure someone who knoww what they are talking about will be along soon.
    Good luck with it all.
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

You should contact the Court where your BR was held, they can inform you who the OR is.

Tell them that you want to check that the house and secured loan have now been settled under the BR.

And no you will not be in trouble, if you were declared Bankrupt and then left the country then your are not liable for any of these debts any longer, therefore you have nothing to worry about.

    Hi goodgirl

First let me say welcome & sending you <<hugs>> I really believe that the emotional stuff is 90% of this process & sounds like you have suffered with the shock element hence the running away. I did that too when I found out how bad my situation was...its nothing to be ashamed of. It is a normal reaction & the OR will appreciate that. The main thing is that you now want to sort it out.

You needed time to get your head together & now the fog is starting to lift & you feel that need to move on.

I don`t know the Scottish process very well but the IS register may be a start.

I think that you deserve a very big pat on the back for coming through this & being able to post & share with us on here.

Hope you will stick around & let us know how it goes for you.

    Take care Honey,

    Angiexx
  • thanks so much for all your kind words and support. I feel slightly guilty to recieve any empathy.
You have no idea (or probably you do) of how nice it feels to finally tell someone about my situation.

I now just need to work out my 'opening line' for the OR/Trustee.....

    Hi GoodGirl

You're right that we DO know how good it feels to 'talk' to someone about this stuff. One fantastic thing about this site is that it gives people who need to get stuff off their chest the chance to do it without any fear of backlash from shocked family/friends etc.

As for that opening line, something like.......

"Hi is that (name) from the OR's office? This is (insert name), you probably remember me yeah? You don't? EXCELLENT!!" ;)
When you're going through hell, keep going! You will get to the other side eventually.

Falling down is NOT failure, failure is not getting up again!

(Two quotes I was given which helped me through the 'dark times')

Hiya and welcome (and well done for coming this far!)

Funnily enough, you've put your questions in order of 'how easy are they to answer?':T

    1) the free way to find out who your trustee is: http://www.edinburgh-gazette.co.uk/ Search for your own name. You can also search the Register of Insolvencies http://roi.aib.gov.uk/ROI/ but you'd have to pay for that (about £17, I think!)

    2) Cut and paste the relevant parts of your opening post into an email, or letter, and send it to your trustee, with contact details. I think your OP explains your feelings and reasons perfectly :A

    3) Impossible to say what will happen. Yes, your trustee can point out that you haven't co-operated and so on. But, given that you would be voluntarily getting in touch with them, and have explained why you disappeared, there is (you'd think) a very good chance that they will accept that you're now co-operating.

    Good luck!
