IPA help

Hi guys I would be really grateful for some advice.

I went bankrupt in feb 2009, after my interview with the OR he said that based on my I&E he didn't think I'd need to pay an IPA. At the time I had started a new job and I told the OR they may be chance of a pay rise of £60 per month after tax after three months.

Well three months in and the company that I work for isn't doing that well so all payrises have been cancelled. So when my IPAQ came out I completed it with the same details as my original SOA. I've gotten home tonight and have a letter from the OR asking for an IPA of £70 per month (on the IPAQ my total disposable income was £72) I'm confused as all my expenditure was well within the allowances. Has the OR changed the way it reviews income and expenditures?

    I'm guessing they may have cut a few things. The usual allowance for medical (prescriptions, opticians, dentists) is £20. Emergancy funds are usually not allowed. Haircuts and dry cleaning are usually £10 each. Have you been asked to buy the BI in your life insurance?

    Your next step is to ring the OR's office and ask for a breakdown of what you have been allowed on your SoA.

    Just spoken to my caseworker who advised that the Examiner reviewed it and calculated the figure. She then spoke to the Examiner who advised he wanted to see my last two months wage slips and a letter outlining why I do not feel I can afford £70 per month. I think he feels I've had my payrise and not declared it.
    I know what you mean about cutting some of my expenditure but I can't really understand how he came to a DI of £140 though?? They didn't want to give me the figures, just told me to write in.

    Any ideas?

    You cannot agree to the Income Payment AGREEMENT unless they provide you with the figures, you are entitled to see the breakdown.

  • I know I've just emailed my caseworker asking for the figures before I respond. Thanks for all your help guys I really appreciate it. I just thought this was all dealt with after my interview. Not sure how they can go back and change their minds when nothing has changed.

  • OMG just received an email back from the OR saying they will give the figures the Examiner has calculated once I have sent back a letter stating why I can't afford the IPA. Is it me or does this not sound right?

    I would hazard a guess that the OR has looked at your I&E sheet and perhaps thought the assistant has been a little generous in allowing all your previous figures. Once the interview is over and all the loose ends tide up and your OR assistant has written their report, your file has to go to the OR for final approval and gets sort of signed off.I could be totally wrong here but thats the way it looks to me.Unless you can come up with a pretty good reason for not paying this i really don't think you will get away with it.SORRY.DX
