Mortgage in joint names

Hi all,
My partner has left me and moved back in with her parents with our two children, she says she cannot afford to give me half the mortgage payment each month as she only works part time and I am the one still living in the family home, both our names are on the mortgage(joint) and I was just wondering what sort of a position I am in legally about her paying half the mortgage payment as both our names are on the account, she is going to see a solicitor on Tuesday to find out the minimum amount she has to give me by law towards the mortgage, does anyone know what this percentage will be? i.e. 50% as its a joint mortgage, I have two jobs at the moment just to be able to afford all the bills and mortgage, I still live in the family home with all the bills etc and she lives with her parents, any help, advice or information on this would be very much appreciated.
Thank
Daniel Short.

She is jointly and severally liable for the mortgage payments, having said that though if she isn't in a position to pay half the mortgage then how can she?
Is this separation going to be long term?
As she works part time, if it is over 16 hours a week and a single parent then any working family tax credit payments are likely to increase.
You will both have to sit down and discuss what is going to happen with the property/mortgage etc as you do not want to get into a position where your credit history is affected by missed payments etc.
It would be a good idea for you to check your legal position as well, if you don't want to visit a solicitor, do you have acess to a legal helpline via your buildings and contents insurance? or try here http://www.communitylegaladvice.org.uk/I am a Mortgage Adviser
