Early Discharge Arrived!!

Hi everyone, yesterday in the post was a letter from the OR's office saying I'd been discharged on 17th July! Great news.

Just wanted to thank everyone who helped me back in Jan when I was filling The Form, going to court and my OR's interview (which terrified me). You know who you are and I could not have done it without any of you. Thank you.

At the bottom of form 6.82 is says "Even though you are discharged from bankruptcy you have a continuing duty pursuant to section 333(1) of the Insolvency Act 1986 to co-operate with the trustee in bankruptcy so that the trustee may carry out his functions. You also have a continuing duty pursuant to section 291 of the Insolvency Act 1986 to co-operate with the Official Receiver regarding the administration of your bankruptcy estate. You should also note that the assets in your bankruptcy estate remain vested in your trustee in bankruptcy and they will not be returned to you. If you fail to co-operate with the trustee without a reasonable excuse you are liable to be held in contempt of court and punished accordinglhy, and you may be sent to prison."

What does this mean? I did not have any assets so think that probably doesn't apply to me. Do I need to tell the OR now if I earn more or if my rent or gas goes up?

Don't worry about that - I had the same on my ED letter - I did have a trustee (and assets) but these were being 'dealt with' - notably the BI purchase. The letter made no difference.
Obviously, if a trustee was appointed in your case, then you still have a duty to co-operate - if not, no trustee is going to be appointed now.
Unless an IPA was imposed during your bankruptcy period, then you do not have any further obligation to inform the OR of any change in your circumstances.
    Enjoy your 'discharge'.

If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • Thanks Rog2 that's so good to know. I didn't have a trustee well that I know of and I assume I'd know about it!

It really does feel brilliant although on a day to day level doesn't really make much of a change it's more a feeling.

Congratulations APC - its all over now! Its a good idea to print out the IIR page that shows you are discharged. You will fall off that register 3 months after discharge.

All the best for your debt free future Applepie.

Don't forget it may be good idea to check all 3 of the credit reference agencies to make sure they have your details correct in a few months.

  • Thanks everyone.

Didn't know that five year plan so I'll do that in a minute and then it's done. Was organised and ready to do the credit agency thingy in a while. Still trying to believe it.
