Been with payplan since Jan 06 none of the creditors have agreed to the payments thus far. Do have my own home that i have a mortgage on not rented. If it does go to court and the judge makes an order as long as it isnt a million miles off what i am paying at the moment then there wont be a problem and i would be able to keep up the payments.0

my previous answer still applies...that is i think it is very unlikely that MBNA will take this course and the judge will apply that remedy.....but the law say e.g. you can be made bankrupt for a debt of £750.
so yes they can apply to the court to apply the remedies they specify. As you have seen, different people have different views about the likely outcome. Unless you do something very stupid...like ignore a summons and dont attend court I think the bailiff is unlikely.....but yes possible...anyway do you much of value anyway...i would have thought a charge on the proprty would have been of more concern.
also do you have the money to pay that amount? if not then there is little you can do anyway.
