London House

Brother has had a letter from london house saying they wish to serve an "order to attend court". He has had several letters and cards following their attendance when he hasn't been home in recent months. He wrote a while ago asking who they are acting for but never recieved an answer.
Does anyone know if they are debt collectors or something more serious. The letter talks about "the order carry's a penal notice therein for contempt of court."! This has really knocked brov, who as i have said before is not at all well.
Any info gratefully recieved.

    All I could suggest is to send a further letter encl copy of previous letter and send it by recorded delivery requesting details of the matter they claim to be pursuing and on whose behalf. Also if your brother is ill, make sure he authorises you to act on his behalf too if he is too ill to pursue matters himself.

  • Need more info, it does relate to a DCA/legal firm, but a summons to court is serious in most cases.

    is the person in question BR?

    Have they had a CCJ which they have ignored?

  • Just a thought, does it mention which court, and when?

    It could be a 'bluff' designed to make him contact them.

    Is there any way you could scan and post the letter, less any identifiable bits obviously, or quote it EXACTLY.

    I may be wrong, but i smell a rat, most court summons come from ...well a court, obviously

    It is highly unlikely for a creditor to take the debtor to court for bankruptcy...in fact they do they are doing you a favour IMO...saving you £510 for a start if they petition your bruv`s BR.

    Can you call CCCS/CAB or Nat debtline for advice.....CAB might be a good start as they have advisers that know the process inside out & can understand the legal jargon.

    Thats assuming there is a court:confused:

    due to the situation there may be one, but dont take it as read there is, just cos a DCA says so.

    What the OP needs to do is go though all mail, if there is nothing from a court, the letter may, and i stress 'may' be bogus, more so, as i said earlier if it does not name the court and time/date.

  • Ok to clarify things, the only place that can issue a court sunmmons is a court, it should not be 'relayed' through anyone else, it would come direct from a court, hence my caution, on the face of this it is a scam, by a very dirty DCA, but it could also be the op does not know, or has not seen the court summons FROM THE COURT, and that is the main bit, without wishing to labour a point, only a court can issue a court summons, yes the DCA could follow up with a letter afterwards, as they do to put preasure on the debtor, but without the origanal order from the court, that in itself means nothing

    If issued by court it should say court name , date , case number etc in top right hand corner. Also will have court stamped inkmark on the first page somewhere. ( a round printed stamp).

    I had another this week from Bradford CC & was clearly court paperwork...no mistaking...even though Eversheds got all the details on it completely wrong!! :rolleyes::rolleyes:

    Thanks so much all of you. The letter brov sent asked who they acted for-no answer. This one doesn't give any info at all about which court it is or what it is for. A it says is that they'll attend on a certain day to serve the "Order to Attend" The last para says if they are not able to serve they'll inform the Claiment who may then wish to apply to the issueing court for an order to effect service by another means.
    I had a feeling it was scam to get my brov to contact them.

    One thing you can do, and this may not work, but as most claims are issued through Northampton bulk clearing centre, you could get you brother to ring them, I don’t know if they can tell if it was issued elsewhere, but if it is through them they would know.

    One thing I would add and you did not comment on, for a CCJ you don’t get 'Summoned to court' until way down the process, assuming it reaches a hearing.

    It may not be a CCJ (as i say your a bit light on info) , so it is hard to be sure, but if this is for an unsecured loan, then it certainly does not sound right, but don’t take that as gospel, as if it is anything else, the system may, and does vary.

    So just use our replies wisely, as I stated, you did not give enough info to guarantee the replies are correct, but on the face of it, it does not sound right
