child maintenace and bankruptcy

Hi all,
I went bankrupt end of May and as my entire income was made up of benefits I had no IPA, he did not even look into my outgoings. At the time I was not recieving any child maintenance for my child, but I have recently heard from the CSA and they are planning on imposing an attachment of earnings to my ex's wages. If I recieve maintenace + arrears, does that mean I will have to be assessed for an IPA as I will no longer only be on benefits?

    No - your main income is only benefits so an IPA is still not an issue for you as Holes has mentioned.

    You still must tell your OR though when they payments start (you have 21 days to do that in). Email them (its easier) and tell them that your income has changed slightly, you now get CSA payments but you are still on whatever benefit (income support?) you get and do they need to have more details. They should email back saying thanks for letting them know, but no, you do not need to do anything else.

  • I looked at the instructions for the OR and although you dont usually get an IPO/IPA as you are only recieving benefits they are meant to check your outgoings.Your maintenance will be considered as income but it will be avery small percentage , if anything, that you will be required to pay.
