Council Tax!

Just wondering if anyone could help with two problems I'm facing,

Firstly - Council Tax rebanding - I have called the VOA re my band currently on Band C, neighbour is on Band B. Our houses are exactly the same. Still awaiting there decision, but I have read about a 6 month time limit? If i'm unsuccessful is there anyway around this time limit?

Second Problem - Council tax Benefit - From the beginning of the year we have received a (small amount) of council tax benefit as we are on a low wage. 10 1/2 K per year. From July our Tax credits has been increased slightly which inturn has meant the council tax benefit has been reviewed and we are no longer entitled? any advice on what I can do to appeal? council tax benefit system really confuses me.

    If you have been occupier of the property for longer than 6 months you cannot make a valid appeal. With a valid appeal, if you disagreed with VOA's decision, you have the right to have matter determined by independent tribunal.

    Even if you are outside 6 month time limit VOA will investigate band, but you would need to show why you believe your band is wrong, which you have already done. However if VOA say band is correct there isno right of appeal.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    yes, for some reason we get to pay £100+ a month because of tax credits. its getting silly, give with one had take with the other. I would rather get given less from tax credits than have to go through all this hassle.

    CTB is means tested so unless its disregarded income the income counts and will reduce your CTB by 20p in every pound of extra income you receive (per week).

    Tax Credits is counted as income therefore you'll not win an appeal about then counting it as income - they are obliged to under the legislation.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
