Advice on CSA Arrers needed please

My OH has been paying CSA via DEO order for the last 2 years with arrears of approx £99 pm included taking the monthly amount to around £500. CSA have now written to him with no explanation and recalculated his arrears and the total monthly payable has shot up to iover £800. Because he pays by DEO we now only have a couple of weeks before his employer has to process the new amount. He's phoned the CSA and emailed them and they haven't got back to him at all.

What should we do next? Is there a way we can stop the new amount going through until we have a full explanation from the CSA on why the arrears have shot up.

    What % of income is this, if it is more that 40% they are in breach of the law!

    I don't know what % of income it is but he is on CS2 rules and the original assessment looks correct. The extra amount is all arrears. How can we find out more info on how they've calculated the arrears and why they've shot up when he was already paying them? And can we stop the DEO change going through until we've got an answer?

    You can't stop a DEO as far as I am aware. You would have to contact the CSA, in writing and ask for a copy of all your partner's data/records, under the data protection laws. They have to provide it.

    Work out how much of his monthly net income 40% is then the CSA can't attach a DEO of more than that.

    If it is more than 40% you can take it further, but you will need to work this out.

    Not totally true.

    For over 6 months the csa took over 50% of my net take home pay. It took ages to get sorted and I am on a fixed wage..no overtime etc.
    During this time i could not pay rent etc and lost my place to live. I ended up living / sleeping in my car for a while and relying on friends for a shower etc.

    Eventually they put things right and they now take 40% of my net take home pay. This is the most that they can take when using a deo.

    I have not managed to get my own place yet and I am still relying on friends for a place to live and a bed for the night

    Then go to ICE and they will get the money back for you. The simple fact is that they can't take more than the 40% it states in the law!

    Obviously I didn't word it very well, they CANNOT take it legally but they do, so I was insinuating that if they have tried to attach a DEO of more than 40% of the OP's partners wages then she has reason to appeal.

    Agreed! they were taking up to 67% of mine untill it was sorted and they had to pay out!
