I would be interested to know how they would know it is you personally from a user name alone?
and if so i would tell them to send onto there legal / management team more like trying to bully you into backing down i would just ask for refund and if they refuse get onto trading standards and let them with there "management" team argue with them.
sounds like a very shoddy company indeed one to note as to give a very wide berth indeed. they dont like you want to return it and have your money back how dare you!

I have asked for a full refund but they say that i am entitled to one due to the item being damaged.
When I received the item i took it out of the box and tested it for a few minutes and i decided that i did not want the item, I then arranged with the company to send it back, However they acknowledged receiving it on the monday and on the wednesday i received an email from them informing me that they have rejected the item due to it being damaged, I was informed that there were scratches on the monitor.
Recently i gave them 7 days to reply favourable otherwise i informed them that i would be contacting the OFT and Trading Standards to complain about the company and inform them of the situation.
We will have to wait and see what happens, I am prepared to pursue this matter and i receive all of my money back, I am currently considering taking the matter to Court and should i not receive my money back soon then that is an option i will have to take.0 -

Any company that monitors these or other boards and passes this information onto their 'legal' team is a shoddy and very unreliable company. It's like they know there's going to be compaints about them so they go and find them. Unbelievable! Wil never shop with them, and I'll be passing this onto my friends and family too.
It's worth calling your bank and asking once again about the chargeback. Most banks don't really know about it, and it's not widely publicised, so you may have been fobbed off.
So what are they going to do about it? Are they offering to return the item to you? So far it seems they have both your money and the computer. Is there a mention anywhere of the serial number? Maybe on a reciept?
It seems like Small Claims is the only option if they're still not giving you the money back. You should be able to file a complaint online. It's then up to the company to prove the item was damaged by you. It's possible they scratched it up themselves when opening it. Who knows.

From the research I have been doing and from what I have been told from other people the company have to provide me with a full refund and then if they would like to try and take action against me then they would have to prove that i damaged the item.
Under the Office Of Fair Trading Guidelines, They have to provide me with a full refund.
They have offered to send the item back to me, However they expect me to pay them to send it back to me, Besides I do not want that item back, I sent it back because I did not want it, I took care of the item, As I have said it was only used for a few minutes and then it was packed away juse like new as I had received it and in the original packaging and i paid Parcelforce to collect the item and deliver it back to the company.
I have already informed the company that should I not receive a favourable response by this Wednesday then I shall be contacting the OFT and Trading Standards and I they don't provide me with a refund soon then I will take them to Court.0 -

The danger of ordering anything on-line is, you cannot determine whether it will be suitable or not until you receive it, therefore, you should at least get a minimum of seven (7) days to try it out for yourself, and be able to return it, safe in the knowledge that you will get your money back.
I had a similar experience back in May with a pair of shoes from Paul Smith on-line, they had a mark on them, and they tried to tell me it was part of the design, but to me it was a fault, they had me take photo's of the said shoe, mail it to them, then I did not get an answer regarding it, fortunately, I was in London some two weeks later, and took the shoes back to Covent Garden store, and explained the situation, and without a fuss, they exchanged them for the same shoe, and I was able to check them out before I left the shop, I was very happy!!
You should definately mail the company directly again, and inform them that if you do not receive a refund for the said sum, you will be informing Trading Standards, and if any company who value their own reputation, I am sure they would not want this. I hate being ripped off, and hate to see companies do this to others, they want you to buy their goods, but hate to give you a refund when you change your mind, for whatever reason. I am afraid I am like a dog with a bone with stuff like this, I think in the end they just give me a refund or swap, just to shut The Gazelle up.

The whole reporting the posts to the legal team is basically to frighten and bully you... The problem is that these people KNOW how many members (and potential customers) can read these negative articles. If people do a search for the company and "Problems" then most of these articles show up.
These threads also tend to attract others to post thier bad experiences which leads to a mass of negative publicity which they dont like.
I had a complaint against HAVEN caravan parks regarding my daughter getting a black eye from one of thier air hockey machines that had no guard on the corner only exposed metal and thier reply was to tell me my "COMPENSATION CLAIM" had been passed to thier fraud squad and I would be subject to prosecution if I went ahead as this was a false claim and I had no proof. When I told them at no point had I made a "COMPENSATION CLAIM" but was pointing out that the machine was still not fixed 3 days later when we left and someone could get more seriously hurt they said that I had no proof and they were going to now investigate for slander. I sent them a photographs of the air hockey table and also had witness statements and then they were as nice as could be.
BTW: I did not ask for compensation nor recieve anything so that was NOT my main concern anyway. I am however still waiting for a copy of the accident report that I logged with the manager at the time (3 people witnessed this as they were complaining to the manager for not getting an ambulance as well). That was over 14 months ago
It just seems to be the way with bad companies.. They tend to try and strike first and put you on the back foot. And hope you will pull all the posts you have made and slink away quietly.
Just a little footnote..
E-mail them (although you know they are now reading this thread so HI PEEPS) and let them know that you will be passing on thier threatening e-mail (because thats what it is) to any authorities you contact (trading standards, consumers direct)0 -

Would parcelforce be held responsible for the damage caused if it was done in transit? Why not get them involved as well??? If you packed it 100% fine and ARIA "SAY" they recieved it damaged then the fault must be with parcelforce.0 -

I think unless you paid for extra insurance then you would only be covered for something like £30 which is no where near the £350 value of the computer.
And it would be hard to scratch the screen they way the item was packaged without doing some other more substantial damage to the computer.
If they won't refund you then get your bank to do the chargeback (see my previous post for the link).0
