Trustee applied to court for sale of house

Rented second property, trustee applied on 27th July for court order to sell house to realise the equity, house as everyone knows has been empty since before BR (BR 23rd Feb), satan the ex and his niece who was renting it had access to it and I none at all, satan the ex handed keys back to building society. What will happen to any bills from Jan til now that have run up as I have had no BI in the property since BR 23rd feb? The house is in satans name as well as mine and he will be getting his 50 % of equity left when trustee sells it, but will I be responsible for any bills? His niece paid all bills I hope up as far as end of Jan this yr and as I have had no access or mail I do not know what has gone on.

I transferred the BI in the other property that was in negative equity over to him a month ago.

I am on the sick still, had my last op 4 wks ago today, and I have my council tax included in my benefits for the rental property I live in. How can I be responsible for council tax or utility bills for a house I have no BI in and haven't lived in for nearly 2 yrs, he is working and I expect his next step will be to forward the bills to me or will my trustee deal with this?

Any help would be appreciated ....I do have another thread with whole story on

    Hi wildthing46

Tough times that you are going through. Just bumping this up realy for a reply...sorry I don`t know the answer.

Be interested in utility bill liability of the BR on a joint property where no BI is in place after BR date (Feb09).

    Can anyone help?

Everyday there is something with him, how can I be expected to pay, he had access it was his niece that was renting it should have been his responsibility to get the utilities turned off. He handed the keys in about 2 mths ago now, so shouldn't he and the building society have sorted this out? Everyday I expect something from this **** it has been a year and 2 mths since I got rid of him and I still can't shake the monster off. I wish many things which I shouldn't and can't say I hate him more than words could ever describe......:mad::mad::mad:

I do have one thing a letter off him dated Dec 08 stating that I no longer have to worry about the property as he will be responsible for it from then on so if it goes any further I will put that through, I cannot hardly afford to live as I am. I have the school uniforms to buy this month and I am wondering where on earth I can make cuts to afford that!

Are any of the bills in your name? Solely?
Unless they are, I fail to see how you are liable - despite the fact that the house is still in your name. If you know who the provider is, calling them and "failing" thier security checks may be an indicator of whether or not you are still the acoount holder....
If you are liable for Council Tax at your present address, you SHOULDN'T be liable for it at the old one - I'm not 100% on that though; maybe try asking the Housing Benefit section at the Council?
These are just random thoughts off the top of my head; more may come to me later.

Who's name are the utilities in? They would be responsible for those.

I need to contact the trustee, as i have had no access to the property as it was rented out to his niece for a year, I do not know whos name it may be in. I think they may be in both our names as both our names are on the mortgage, but I have had no BI in the property or access as he kept all keys to stop me from having anywhere to live......so I have no way of checking this. I have an audit trail of correspondence with solicitors and him regarding the situation and no-one helped me....the trustee and OR and a manager of the council tax are aware of what he did and are aware that I have never had access to the property. I will contact the trustee tomorrow. I am stronger now than i WAS at the beginning of the year and i WILL fight him tooth and nail this time, I am not working and so I am not paying. he is working so they can chase him, if they chase me I am still bankrupt and will be for another 7 mths, and I have no spare income, so where he thinks he'l get it from I don't know....I cannot go back to work due to accident and varioius surgeries and will be out of work for months to come. So they can try but you can't get blood out of a stone.

called the trustee and they have told me to send all bills to them they will write to all concerned and inform them that I am not responsible. Satan doesn't realise yet but he is solely responsible for it all........

Emailed council tax after speaking to them, telling them the whole story and about how nasty a pasty satan was.....had an email back stating they were putting the account into his name solely and he will be charged for it. They said they were sorry to hear of my misfortunes and wished me luck for the future........

So now I expect satan will send the bills to me recorded delivery and will order me like a dog to pay them.......and I will:rotfl::rotfl::rotfl:

Good Riddance of him and the houses.....:j:T
