Requesting all correspondance from mortgage lender

PLEASE HELP

How can I request all correspondance, including notes on phone calls, mortgage application, request for renewal/extension, signed title deeds - the lot! from Leeds Building Society.

I have since found out that our lender has not followed through with information and forms, from advice given, and has failed in their duty to port our mortgage across to another property. I will need all evidence.

    In writing via recorded delivery or perhaps via a solicitor, I dont know if they are required to send all the information you are requesting or not or who much they can charge you for this service, Im sure someone else will know better than me though.

    rocket - are you sure the mistake is thiers?

    I come accross situations like this quite often, and so far always it was the client that misunderstood.
    The lender will usualy state the client was fully aware of the porting terms as laid down in thier original mortgage offer (the one from the existing / prior property).

    Loan to value on the new deal should reflect the LTV maximums as shown in the original offer. You cannot for example port what was a 75% deal, where the new arrangment is above 75%.

    Not sure if that helps, or your situation is different.

    If you feel you have a case, then make mention in your letter of 'TREATING CUSTOMERS FAIRLY' as this is the KEY principle that applies here, and TCF is at the core of FSA regulation of mortgage lenders.

    Porting your mortgage isn't an automatic right, and you have to comply with present lending criteria, rather than the criteria from when you first arranged your mortgage. They certainly don't have a 'duty' to allow you to port.

    I think rather than wasting your energy on this, you should be looking for a new lender, or looking for rented accommodation in the area you want to move to. It seems like cutting your nose off to spite your face to cancel your new jobs and the sell of the house, when renting would be your ideal solution.

    Under the data protection act all you need to do is ask the lender for copies of all information held about you, speak to their customer service/complaints department and tell them that you want to apply for all the information held about you by them as per your rights under the data protection act, ask them what they will charge for supplying that information. Once they tell you what it will cost put the request formally in writing, with the appropriate fee, send by recorded delivery.

    You will probably find that they will ask you why you are requesting this information and will try to resolve the issue without having to produce the information because it is a nightmare for them! As they literally have to provide everything that they hold on you, so likely to be a lot of information!
