    Sorry... I'm getting very confused... Does it depend on who regulated the IFA (at the time) as to whether data protection laws apply? What gets me, when the solicitor asked us to fill in a questionaire - we gave him all the info he wanted... Should work both ways.

    Shouldnt do as that court ruling was not specific to a class of business but to all businesses.
    What gets me, when the solicitor asked us to fill in a questionaire - we gave him all the info he wanted... Should work both ways.

    Whilst there are many genuine claims, there are also people trying it on. The current situation with the claims process is that there is nothing to lose in putting a complaint in. Having everything on the file to see if there is a "hook" into something that you can exploit is exactly the sort of thing that this court case ruled against.

    If you have the data supplied, you could just copy it and that wouldnt highlight any differences which may work in your favour but may work against you.
