Spoken to the Insolvency Service.

Abit of a concern, basically as people know, our son gets DLA money once a month. The chap on the phone has said the OR may ask DH, why do we not get a mobility car for our son instead of me receiving money for him. My answer to this would be, I have the money, as if there is anything he needs that will provide help with his disability, I can go and buy it for him, out of 'his' money, rather than having the car.

I need to get some idea's whether or not this would be an appropriate answer.

Tell you, when you think its all answered, something else crops up!!

I'm not 100% sure but would you not be able to get a car and still "some" money? Or would the car stop all money to you?

Must admit he was a little abrupt on the phone to me
Maybe I should phone again next week.

His exact words were 'One of the questions your DH will be asked is 'why' we haven't got a mobility car for our son' So I answered 'well getting the money is easier for me, incase my son needs anything spending on him, regards his disability' and I was replied to 'well it's something he'll have to speak to the OR about'!! Charming!

The way he's made me feel about it, that we may not be allowed 'any' car.

I mentioned what about putting the car in my name and he said ' have you got £3700 to buy the car' The answer to that was 'No' :o

I don't think having a motability car for your son has anything to do with your OH's car TBH.

The car would be for use in transporting your son and making his life easier, not for your OH to get to work.

What would happen if your OH took your 'sons' car to work but you had to use it to get him to appointments etc.,

That just doesn't make sense and I think the man at the IS is talking out of his @rse.

If you OH NEEDS his car to get to work you should be allowed it, regardless of other arrangements you have for your son. Admittedly it's unlikely they'll let you keep the one worth £3.7k, but they should either let someone pay the difference between that and £2k, or take the car and give you £2k to buy a cheaper one. Your OH must make it clear to the OR that without a car he cannot get to work.

    Thankyou Peachy.
Trouble is I have to rely on DH, as I don't drive, so when DS needs to get to hospital appointments etc, DH has to take me.
I don't use public transport very often, a couple of reason's, its a nightmare, two children and me (1 in a pushchair) and sometimes appointments are at a hospital, that is two bus rides away.

To be honest the chap at the IS has got me slightly worried, we may end up with no car, as he seems to come across anyway

Could my DH sell the car and buy a cheaper one before he goes BR?

In that case ignore what he's said, it's none of the OR's business what or how you use your sons DLA. If you can't drive there's no point in getting a motability car, end of story. i think he was having a bad day, this has never, ever, been raised by an OR with anyone here before.

If you sell the car and buy a cheaper one you must sell it at market value, and you must give the OR the difference between the 2 cars.
