I've just been threatened by Triton

    Not my specialist subject, but I'm pretty sure that as Triton are the ones you have been dealing with, there's not much point in talking to RBS as well. Who actually owns your debt is something they need to have a bunfight about, not you, and as you have been paying Triton I suspect that answers that question anyway.

    Either which way, returning your letter hasn't reset the clock on the 12 days they have to dispatch a copy of a valid CCA to you, so I'd echo rog2 - ignore RBS, wait for the deadline has passed, then if they haven't sent the CCA, send the 12+2 letter (with the bit about the 30 days removed, as that is no longer law - ask if you are unsure on this point!) to Triton. Then sit back and see what happens!

    If nothing else this will establish whether or not 'TRITON' are, in fact, an integral part of RBS, as I suspect they may be. If so, this brings us back to what the OFT says about 'pretending to call from another company in order to deliberately confuse the debtor'.

    I'm confused too - on all my bank statements it says that I pay Triton, but have heard nothing from them, just this letter from RBS. I have put together a letter to RBS (below), am just thinking about whether or not to send it?

    "With reference to your recent letter regarding my request for a true copy of the credit agreement for Triton reference 33xxxxxxxx, I hereby return my original letter and postal order and request that a copy of my credit agreement is forwarded within the time originally requested.
    Furthermore, I wish to question the ownership of the above debt, as I have been contacted by Triton Credit Services about this matter by both letter and telephone and have been making regular payments to them each month for the past year, yet it is the Royal Bank of Scotland who are now writing to me for clarification. If it is the case that Triton does not own this debt, then I must question the validity of my payments, and further to this will begin to make enquiries as to whether or not fraud has been taking place with regards to my account.
    If it is that case that Triton are a subsidiary of Royal Bank Of Scotland, this I wish to question why it is impossible for you contact Triton using their reference to gain the necessary information which you require, as I do not currently have this is my possession, having not received a statement of account for more than 12 months.
    I trust you will deal with this matter with the urgency and seriousness which it requires and look forward to hearing from you in due course."
    Jesthar - the loan was taken out at the beginning of 2007 (about Feb I think).

    I would give it a week or so before sending anything like that, Tracey. You could, unwittingly, be playing into their hands by diverting the attention away from your cca request.

    Having looked ( and looked and looked again!) with a clearer head (worked 12 hrs straight with 2 1/2 hrs driving on top :eek:) I can see what you all mean.

    I'll wait for a week, then send the non-compliance / default letter and see what they say. If they start getting sh***y with me, I'll begin to make enquiries as to who people are etc.

    Thanks again for all your help and advice - you all make me less scared and intimidated! :T

    Glad you're feeling more positive about dealing with this shower of idiots (wait a minute, don't Triton make showers as well as hassle debtors? Nah, probably another Triton :D)
  • I am a bit more positive about dealing with them, yes.

    I'm glad that I decided to ask for help as I think I would find it hard to cope with on my own - especially as I don't have huge amount of time to research things at the moment.

    To be honest, when they started calling and sending letters, I was so tired and down that I thought 'why not just try and pay them more each month to get them to stop?'. Then I had a moment of clarity and realised that was what they wanted and would never stop regardless of what I did.

    So, thanks again all - hopefully I'll be able to repay you all with some advice in the future (if you need any biscuit baking tips or info about mental health, I'm your gal ;)).

    I can understand why Triton are wearing you down, they have been ringing here 5/6 times a day for the last week, even though we're in a DMP and have been paying RBS since March.

    I spoke to them the other day though (more fool me!) and they actually said they are part of RBS and they use the same system.

    I really hope they can't provide the CCA and it becomes unenforceable, serve them right for mithering you! Good luck :)

    Hey hayley,

    Have you sent them the telephone harrassment letter and demanded they stop calling and deal with you in writing only? If you have, and they still call, they are being very naughty debt collectors! ;)

    If not, you can find the template letter in that thread I posted up for Triton earlier. :)

    You're welcome! Remember to send it recorded delivery, that way you will have proof they have received it (so they can't lie about that), and just print or type your name, don't sign it.

    Oh, and next time they call, just say to them that you no longer wish to deal with them on the telephone at any time, you wish to be contacted by letter only, and that all future calls will be logged and reported to the appropriate authorities - then hang up on them ;)
