Sale shoes not on sale? - Need advice

My husband was looking to buy a pair of Timberland boots at the sales yesterday. The pair he wanted were originally priced at £90.00 but had a sale price tag on them of £50.00. The tag itself was not a sticker but a tag that could only have been put on by the store staff themselves. ;D

When he went to the till to pay for them the cashier informed him that the tag had been put on the shoes in error and she would have to charge the full price of £90.00. :o

My husband stated that he felt he should still be allowed to purchase them at the sale price since they were advertised at the sale price. >:(

The cashier advised my husband that the store was not obliged to sell them to him at the sale price as they were not advertised in the window at this price. In fact they were not advertised in the window at any price. ???

Is the cashier correct, or should my husband have been able to purchase the shoes for the price stated. I would appreciate advice regarding this. :)

  • New laws have been bought in to protect the retailers against theft from swapping of price tickets - basically they are no longer obliged to sell you a marked down item at the reduced price.

    Personally if it is an error of the assistant (and not something that can be done by the public), depite the fact it's not 'advertised in the window' the customer should get the item at the reduced price.

    Most retailers have a central computer where the items are updated so when they're zapped it comes up with the reduced price.
    If you have any queries get them to price-check it for you thorugh the till-point.

    if the tag had been clearly put on by a member of staff . accidently or not then i would have said to the cashier if i dont have them at the reduced price then i dont want them at all and said will go elsewere.. sometimes this works sometimes it doesnt.. This has happened to me before and i just go elsewere if i really want the item ..

    This is also an interesting article about mispricing. If however you feel the shop is being deliberately misleading over the price you should contact trading standards as it is an offence. Most big retailers will honour mispricing but smaller shops don't usually. I had an assistant in M&S tell me she would get a slap for selling me shoes marked down by them to £3 that were actually £30. I rung the manager to make sure she didn't get a slap!!!

    Thanks to everyone who replied to my query.

    In the end my husband bought a pair of Caterpillar boots reduced to £35.00 in Next sale, so he no longer wants the Timberlands.

    However, I now know where I stand if this should happen again in future.
