National debt line, they're a free company that's recommended by the government and here, I found them brilliant. They don't organise plans, but they do give advice.

:( Had a letter today from one credit card telling me they sent me their 'self help pack' on 2nd June and as yet they still have not received my completed Income & Expenditure form with proofs therefore my application for financial difficulty has been declined, and my account will be treated as normal!

Yet I have sent them an I&E sheet, ok so it wasn't the one their company sent me to complete as I had already returned one done on CCCS website before they sent me their 'pack'. I sent it recorded delivery. :(

The most annoying thing is they said themselves in this letter that they can see I spoke with their 'Specialist Support Unit (SSU)' on 25th July 2009 and advised them I will be paying £1 per month. I first informed their company of my financial difficulties on 22nd May and they sent me their 'Self Help Pack' on 2nd June. So why do they say they have declined my application for financial difficulty and treating my ac!!!! as normal

Every letter I have sent them about the debt has been recorded delivery. How do I check it was received and who by?

What do I do next?

    Thanks

You go to the Royal Mail website and put in the code on the recorded delivery receipt, that'll give you a copy of the signature of who signed which you can print off.

    Hi
Thanks for that info. I have just checked on the site and it shows a signature but no time or date so I assume it was received / delivered.

Is it worth writing back to argue / point out that I did send a copy of my I&E it just wasnt on their letterhead form (but CCCS printout) and to stop being so idiotic but if they really want it on their form if they send me one I will complete it again but it wont be any different to the one they already have so it wont make a difference just take up time? Or shall I just send them another I&E form from NDL website?

    What do I do now?

I feel I am getting nowhere and wondered if I am I better off going for a DRO or seeing it through this way?

Why won't they listen to me when I say I cannot afford any more? :(

    Thanks

I'd be inclined to use the broken record technique - just send them copies of earlier correspondence if you know they are ignoring parts of it. Also point out that you have sent everything recorded delivery. Seems to me this is bullying tactics to try to back you into a corner so you'll pay more than you can afford. You have done everything the right way, stick with it.

You've only been paying token payments for 3 months. DCA's/creditors take a while to get their head around the fact that if you haven't got it you can't pay it - they seem to struggle with this basic fact.
Let's face it if you lent someone some money would you go away after a few months? or would you carry on for a bit desperately trying to wring every last penny out of them and possible even lean on them/threaten them? before accepting the inevitable.
They are out for every penny - you are doing all the right things - stick with it. They just think if they threaten you enough/shout loud enough or just generally ignore you, that you will somehow find the money by borrowing more etc.
With regards to the DRO thing - it really does depend on your situation - a dmp is an informal arrangement whereas a DRO is more legally binding I believe. It depends on your circumstances - I know with some jobs that bankruptcy can affect them eg financial and legal positions you can be prevented from having - not sure if a DRO is the same or not. Also it depends on whether you are working or not - if not whether your situation is likely to improve in the near future so that you can up your payments and pay off the debts sooner. Also there are certain criteria to meet for DRO's - you would need to look them up and speak to one of the debt charities to see if this is something they would recommend to you or not.

Obviously having been paying token payments for 3 months now your file is not in good shape anyway and no doubt even when you were somehow paying it would have possibly indicated you were overstretched anyway - so not sure how you think this means your credit file was in great shape? and the last thing you need right now is credit - getting out of the mess is important- protecting your credit rating is not really.

    Best of Luck
