Private Rent and BR.

As most people will have seen from my previous thread's, we're going to move into Private rented accomodation before my DH goes BR.
How does this work though?
Most of the property's I have seen are through Letting agents, will they not have a right to evict us, when they hear of the BR?
Also with alot of the letting agents, we have to pay a fee, and have a credit check, how do we go about seeing the contract before we pay anything out?
Would it be worth mentioning to the agents, that DH 'may' be going BR? Or do we keep hush?
The last thing we want is to move into rental, and then find out we're not welcome there once DH goes BR.

You know what (and I bet I get flamed for this...) - I would keep quiet - provided you are sure that the BR is going to be after you move into the property.
I am sure that you can't be expected to foretell the future and - how were you meant to know that you were going to go BR when you moved........?
(Having said that, are you moving because your house is being reposessed? Not sure if that doesn't get flagged up somewhere...)
If you aren't in any rent arrears at the the time of your BR, I don't think the OR should be getting in touch with the LL or LA and morally I don't believe they should if the LL isn't a Creditor. It may differ between OR offices but I know that I have read on here of ORs not getting in touch with them if asked to and no money owed. On the ether hand, my OR did and there was no reason to and my LL tried to say that I owed him money when I most certainly did not; think he was trying to stiff something from a payout or something..
Upshot; my opinion - don't tell them. That may also depend though on what the state of your credit report is before the BR and what they are asking of you when you apply for a property - you may be ruled out anyway. It's to tricky......But it's up to you.

Do you think you will fail the credit checks before BR? most people who end up BR would fail the checks as they have a poor credit file already, if you think you will fail best to come clean with them.
It may well be a clause in the contract but they wont evict you due to BR. If they tried it would not stand up in court, the BR clause in a rent contract is purley there so if you are in arrears they can get you out quick. There are 100's of empty properties at the moment and Landlords are getting desperate to get them filled.
My advice is to make sure you pay your rent on time every month and dont give them excuse to evict you. Once you are in the property they will only be bothered about you paying your rent regular and keeping the property in good order.
The OR Can and often does contact the agency or landlord and inform them you are BR thats why it is best to tell them first. Tell them you will make better tenants as you have no other debts to pay :-)0 -
Not sure how the credit rating will go, as my DH has already defaulted on Loans etc, by joining the DMP, that he's currently paying into.
Once we have found a property and got excepted for it, thats when we were going to stop paying the mortgage etc, as thought it best that way.0 -
hiya my opinion is to be upfront and honest - we had our house repossessed and had to find rented before going BR - our credit rating was shot so we found a property we liked went to the agents and explained our circumstances to them (and that we were NOT going br due to not paying utilities or essentials (bit of reassurance for them)). They understood as they were getting a fair amount of people in similar situation - they phoned landlord to ask if he was ok with it and he said as long as we pay the rent he is not bothered, they did a basic credit check which is just confirming you are who you say you are and we have been here nearly a year now.
The prob with keeping quiet is if you do get found out it creates suspicion - also some contracts have a clause regarding br and eviction - if they know upfront you are protecting yourself.
I would phone a few agents in your area and explain your situ and see which ones are ok with that and look at their properties (you will find that they will all be ok with it)

I have phoned an agent in the Derby area, which is where we are looking, the down-side to it, I mentioned to the lady, by DH may be looking to go BR, what happens regards rents etc.
She did say they wouldn't say 'no' but gave me an example 'A guy went in to them a week or so before, explained he'd found a property for £495 PCM, and explained he was BR, he had to put a £1500 deposit down and have a guarantor :eek:
We are looking at properties in that area, upto £650 PCM, so god knows what our deposit would be, and not sure we could guarantee a guarantor either.

I have spoken to quite a few LA's as we too are thinking of move into rented before BR (just not 100% sure yet). I think its best to be up front about your situation, its one less thing to worry about when you do move somewhere, whether you will get "found out" or not.
Most have said they would put circumstances to the LL and go from there. Some just do a basic bank acc check to see if wages are paid in regularly and may ask for an employer ref. Some require a guarantor, i dont know if you can get one that would help? Also 6 months in advance is acceptable to some too.
I think you just have to get yourself in the best position possible, find a house you like, put yourselves forward and see if you get accepted. Good luck with what you do. Dont be put off by that one agent you rang.

We have been speaking tonight though, and think my DH may file for BR whilst we live here, in our mortgaged property, and then go to a private landlord who won't do the checks etc, well hopefully :rolleyes:

Please be aware the Official Receiver may contact your new landlord, if he hears it from the OR he may panic and ask you to leave.

OK, not sure what we should do now, should I contact private Landlords now, even though we're not thinking of moving yet, or should we move to rented, and explain the situation then?
DH wants to try and stay here and BR, but now I'm not sure what would work better.0 -
I noticed your mortgage is a lot lower than the rent you will be paying, have you not thought about trying to keep the property? without all the other debts would you not be able to afford the mortgage?
It depends when you go BR regarding the rental, I work in residential lettings and my experience is that landlords mainly accept a BR tenant as long as no fraud comes up on credit checks. Like I said earlier there are alot of empty properties around that need tenants. The just like tenants to be upfront with them.0
