posting for SIL re stopping CSA arrears help please

Hi all, i hope someone can help us here!

My SIL has 4 kids 1 with her ex and 3 with my brother whom she is married to. Her 1st childs dad has always paid via csa no probs. He was put on short hours for a while about 3 years ago and he requested a re-assessment they failed to do this so my SIL asked for re-assessment. Anwyay, in the mean time his hours picked up and he got a promotion so all was forgotten re the re-assessment as he could afford the payments once more (he did keep up with all original repayments even when on short time).

The CSA decided about 9 weeks ago to action the re-assessment from August 2006. They are now saying SILs ex must pay an additional £24 per week and arrears totalling £3900!! Both SIL and her ex have told CSA this is outrageous but CSA have put a DEO on his wages for 40%

Surely if my SIL is happy with the arrangement that the CSA originally said she can close the claim and in effect 'wipe off' the arrears then start a private agreement? CSA are saying she cannot - surely she can? She trusts him to pay, as fortunately this is one case where both parents truly have the children's involved welfare at heart

My SIL has never claimed benefits and gets £40 pcm in tax credits of some kind. I know that benefits are relevant so thought i would mention it

    As long as she has never claimed income support then the arrears should be due to her and she can do what she likes with them. She can even ring CSA and say that her ex has paid her a lump sum direct off them, paid her all of them, or that she wants to close the case.

    Well I suppose if this happens... worst case scenario... she can willingly give the money straight back to him :)
