OR Questions.

I'm not sure whether I can ask this, but just wondered what sort of questions the OR will throw at my DH, when this time comes?

Will the OR question money that we leave in the 'old' joint (soon to be just a single for me) account, after my DH has opened the Co-Op one? There's Back payment for DLA in this account, and possibly around £600.00 savings, incase anything went wrong with our home.

Are we right in thinking, leave it about 3 months before going BR, once the co-op account is opened?

    So before the OR actually calls, my DH will already be BR? Or is it the OR that will decide?

    It is the judge in court that will declare your OH bankrupt (although he may not necessarily see the judge in person). The OR interview if he has one will come later by which time he will already be BR

    What about the money in joint account, should we just transfer the £600.00 over to the co-op?

    Are we right in thinking, leave it about 3 months before going BR, once the co-op account is opened?

    Is leaving it about 3 months right, or just file straight away?

    What will happen to my DH first wage, that goes into the Co-Op account, if he files for BR straight away? As obviously he'll need this to pay rent, utility bills etc.

    This will be fine, the OR will not take the money he needs for his living expenses. You can empty the bank account the day before you go to court if you want, but if when he gets paid after his court date his money will be safe.

    You don't need to wait 3 months, you can go BR as soon as you like,

    I would open a new savings account in just your name and put the £600+ in there, your OH wouldn't have to give the OR details of that account, but would still have to give statements from the ex-joint account.

    This will be fine, the OR will not take the money he needs for his living expenses. You can empty the bank account the day before you go to court if you want, but if when he gets paid after his court date his money will be safe.

    So if he were to go Bankrupt middle of August, he gets paid end of the month, DD go out on the 1st September, the money will still be in the account?

    Will the OR not question where that £600.00 has gone? Could DH state that its my savings from the joint account?

    We have the deposit for a private rent in joint account already, so once thats been paid out, I don't imagine there'll be much left in that account anyway, :D

    Who would he phone the Co-Op or the OR? to make sure is ok to carry on using account? Sorry I must sound so daft, but its all new to us :rotfl::D
