    If you want to pay back your debts - and if it's do-able financially - you might want to look at DAS (Debt Arrangment Scheme) too. Your creditors would have to freeze the interest, and couldn't take any more court action against you. It's not insolvency (unlike bankruptcy or a trust deed), but it will affect your credit record.

    One problem. You can get onto DAS if you have a wages arrestment in place. But you can't get onto DAS if you have a conjoined arrestment in place. So you'd need to check it out pretty quickly.

    There's info on www.moneyscotland.gov.uk (it's a government run scheme and a government run website). It has details of DAS money advisers all over Scotland, so you could try to speak to one near you if you were interested. Or you can phone the DAS helpline on 0845 612 6425 - they won't be able to give you money advice, but they can tell you how DAS works.

    It's just a thought, and it might not be the right thing for you at all.

    If you're thinking about bankruptcy, please get some advice about the implications, and check whether or not you'd be eligible. You don't want to lose your £100 fee because your application is rejected!:eek:

    I know I am eligible for BR, just not sure I want to go down that route.

    I eventually got a respones from the head of payroll after hounding them all week, they still think they are correct in enforcing the 2 seperate arrestments.

    I referred her to section 59 (1) of the Debtors (Scotland) act 1987 and she said that because they are for a diffrent debt from different people they can enforce them until a conjoined arrestment comes through.

    She also told me she has informed the 1st company that they may want to apply for a conjoined arrestment, doh, they are not going to do that, simply because they will lose a portion of the max amount they can deduct from me.

    I gave her the number of the people to contact about the 2nd arrestment and she says she will call them and see what they want her to do.

    I will call her again tommorrow and find out what was said, as I don't want (can't afford) this being deducted again, the payroll run starts shortly I believe, so it needs sorting out and fast.

    Next step is the court, as the nice lady said I was to write to them, explaining all this and the court would give a ruling on the arrestments.

    A bit of a result. :)

    The company stopped the 2nd arrestment, after they discovered what I have been telling them is actually the truth.

    Also got a cheque through the post from my work, for the full amount of the 2nd arrestment, they had deducted from me, as I assume some has had their back end kicked for doing it in the 1st place, also I think it's probably more the fact they found out they wre in breach, that made them refund me the money.

    I will now just wait and see if they try and claim the cheque back of this months wages.

    O the joys lol.

  • i had 950pounds arrested from my bank for council tax arrears to fill u in i got made redundent and fell behind i started a new job and contacted the council office to make arragements to pay this off they asked for my wage slips and bank statements and before i could get these items together they took nearly all of my wages leaving me with my overdraft to survive on witch does not even cover my rent they sent me letters dated 4days after they took the monies telling what they were going to do is this correct ps i live in scotland

    I'm just wondering if the guidelines in England are different, as perhaps being such a big company, your employer is working to English rules?

    The English & Welsh rules allow 2 order to be in place at anyone time for council tax purposes.

    The 1st order is calculated based on the % band that wage falls in to.The 1st amount is then deducted from the wages and the 2nd deduction is then taken depending on what % band the remaining wage falls in to.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
