    My wife and 2 kids are in the same position almost, we have had our house repossessed already and someone has done us a favour by letting us one of their houses , however they have new tenants moving in on the 1st Sept the council have told us if we leave willingly or if you give up voluntary repossession they will not rehouse us, there are 22,000 on the waiting list where I live so we lose points however they did say that my wife and kids could go to a homeless hostel. you need to register yourself as home less, that was the advice I was given

    Hi Angie,

    I know where we are in Scotland you can only be in B&B for a maximum of 2 weeks if you have children. I don't know the position elsewhere but Shelter is a good source of info. Some won't accept pets so you may have to arrange for someone to watch your dog for a while - better to have that as a fallback plan than to be hit with the news and given no time to make arrangements.

    Thanks all for replies, I have lots of questions for the CAB, have been waiting ages to talk to someone face to face.

    I have had great advice from people on here which i am truly grateful for, reading posts on here has kept me going. I know we have to go BR i have just been so scared about doing it and have spent the last 3 months finding out all i can.

    I thought i would start a new thread soon with my experiences, but i have just tackled a huge complaint to a debt advice company that made promises to us they didnt keep and i am pretty worn out with it all!! Enough of me moaning, sorry to jump in jimbob84 on your thread but take care and hope you get advice you are looking for.

    Not a problem Angie! The more info I get and the more I read about other people on here helps alot as im realising that im not on my own and that the thoughts ive had about doing a 'Runner' are also had by other people!

    I spoke to CAB and yes they advised me not to hand the keys back as the debt would stay with me even after the property has been sold. My only option now is to go BR as majority of my debts are secured and when ive enquired about an IVA because I only had around 2000 unsecured I was advised that and IVA wouldnt be a viable option really.

    The more ive read, the more I now know that I have to go BR, im going to complete a SoA before I ring CCCS as advised by TigerFeet on another thread! That way I should be able to give them all the info and get some more advice and then see where I stand.

    The thing I really want to get sorted is getting a job again before I go BR so that I can get a rental before declaring BR, that way when the house gets repo'ed I wont be left on the street.

    When I get more info and advice off CCCS ill post again on here. It's been great so far as everyone on here is very friendly and like I said before I now know that my situation is very different from alot of other people on here.

    Hi JB

    I completed CCCS online debt remedy which recommended BR for us. I then was emailed the next day a reference no and the CCCS BR team phone number. When I called them i spoke to a really helpful adviser who talked me through the whole process, she advised us to give up house (this is what i am still unsure of at moment hence hoping for more advice from CAB appt mon) and gave me her personal email address if i need to ask any more questions. V helpful i thought.

    She also went through my SOA and adjusted a few figures. Then i got a copy from her in the post, one for BR and one with a £4 surplus to present to my creditors.

    I think this whole give up the house/ let them take the house is so confusing. I have been given different advice on this too but I am going down the road of letting them repossess rather than handing back the keys.

    I agree !! The way i look at it is whether you hand the keys back (vol repo) or you default on mortgage and the bank repo house its the same thing at end of day. The house still gets repoed, the bank will then sell it probs at a loss and whatever shortfall there is goes into your BR.

    Its just if you are hoping for council housing assistance you have to stay in house till eviction day or you will be classed as making yourself intentionally homeless and council wont help you then. If you have vol repod and moved out it is down to you to find rented. This is where can be tricky as we have been finding out!!

    Got a dog so thats not accepted by some landlords, if you cant pass credit check that can be another hurdle, if you cant get a guarantor that can be another route closed to you, if you can provide 6 months rent up front that can be a way in, it all seems to depend on the landlord and how your circumstances are presented to him. We have been told by one letting agency not to tell the landlord we will be going BR, we want to be up front about our situ so we are still pretty confused as what to do:confused:

    Our local housing is with an housing association so we had to register with them first and also register as homeless/or about to be with the council first. We did this as soon as we knew we were going to get repossessed. It has been a struggle with them, ill admit, but private renting really do not like Bankrupts. Every form reagarding repossession i have had i have copied and taken to both the above and kept them up to date. We have a court date next monday, i rang them both for an update last friday and they have both clarified that the paperwork has been sorted and its with the manager to be signed.

    You have an interview with the council and they do try to deter you from registering and they do say you may end up in a hostel etc, but they are saying this to try and get you to think about private renting or living with relatives, the CAB will tell you they are doing this because they want to put you off, for reasons that are beyond me im sure!!

    As soon as you get on the list to bid you can check what properties are available and you can bid for the best(of which are appropriate)as you will be priority. If it gets to a stage where you have not bid and your repossession notice is nearly up, the council will make you only ONE offer of an house that they deem suitable to you and your family. You can always apply to the court for extra time in your current house, as the CAB and the council will tell you.

    This got us as well, because we were with CCCS on a DMP and they advised us to hand back the keys but Debtline, CAB and Council all advise against this, so we decided to let the mortgage co. repossess.

    We were looking into private renting before we went BR but apparantly some contracts have BR clauses and we didnt want to be back where we were 6 months before because of it.

    WHilst your wating for answers and things to happen its like being in limbo, but we have to keep going for the kids and hopefully everything will turn out ok.
