Albion Collections LTD Please Read if you are having problems.

Hi all,
I have been dealing with Albion Collections LTD acting on behalf of the halifax. However having done some research I have found the Following
cite that you have contravened the guidelines for debt collection laid out by the OFT while i am happy to discuss any debts with you I am only willing to do so if the guidelines are adhered to. Furthermore I am only willing to discuss this with someone who has a full understanding of the Following. FSA guidelines relating to the consumer credit act and the collection of debt, OFT Guidelines for debt collection and call handling, The banking code in particular statutes of the code that relate fully to priority debts.
If you are satisfied that you have someone who able to deal with my quires and questions then I will be happy to communicate with them.
You have contravened the OFT Debt Collection guidelines in the following manner as you are solely or partly owned by HBOS PLC.
I cite into evidence of this the following domain record. This is evidence of your company being owned and operated by HBOS under the Nominet codes of practice for domain name registration.

I have since reported the matter to trading standards as you can see they are clearly owned and operated by the halifax.
Further more they may or may not be committing a Civil fraud.
Having phoned albion on 10 occasions 5 of which where answered by Halifax Retail Bank Collections it seems evident that they are part of the HBOS.
If you receive a letter from Albion regarding a Halifax Debt report it directly to the OFT as a breach of their guidelines.

Presumably this could also work for Blair Oliver Scott - they do collections for HBOS and are widely known to be part of the group (although they do not declare this on any communications).Amount saved by cutting down on :beer: since 24/08/2009....... :j£81.78:j0

please be advised that Blair Oliver and Scott have no right to claim they are solicitors and it is alleged in some cases they are is they do state this then report them to the OFT, Trading Standards, and any legal watchdogs they are not registered, or regulated by the law society.0

These guys are useless i am in arrears on an AA loan with them. I stopped talking to them on the phone because they were rude, ignorant and did not care about my individual circumstances. So i decided to ignore their calls and requested they write to me. Which they did not. So i wrote to them to politely ask them to tell me what the arrears were and could i have a direct debit form so i could resume payments. Have heard nothing but i still get the calls left on the answering machine. I even sent them a templated letter (from this site) explaining they were in breach and that they should hand my account back to the AA. Never heard a word. I even wrote to the AA asking them to write to me and update me on my arrears. How an earth do i resolve this if they do not want to contact me by letter. Surely i have good grounds to take them to court for breach/mishandling of my account in other words assisting me into getting into more debt!

You have requested to deal only in writing and as such you should refuse to talk to them on the phone when they ring and refer them to the letter, also note to them the call has been logged as you had requested not to be called.
Do not setup a direct debit, a direct debit means they can attempt to take any amount, use a standing order instead, so get their bank details this way you can control the payments.
If they won't deal in writing then just refuse to deal with them as they would be in breach of OFT guidelines and data protection to keep on contacting you by telephone.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
Thank you for this information. They have stopped ringing for the first time in months. I expect a letter from their solicitors shortly or perhaps they got the message.
I think the best thing is to resume paying something then they do not have grounds to take me to court though i guess they will argue they have used all means to contact me by phone. I gather that these DCA's are only versed in phoning customers and not trained to engage in letter writing and so my problem simply will not get solved.

I got a letter from the AA who informed me that if my account went 7mths in arrears they would pass it over to there debt collection agency i.e. Blair Oliver and Scott. Which confirms they are indeed not solicitors
Also Albion, the AA confirmed to me are there in house collection team.0 -
