Am I Status Barred/what's next???

Morning all,

Im 26 and I have recently received a letter from a company, who state they are acting on behalf of Lowells Portfolio1, for a credit card issued by HSBC I stopped paying around 5 to 6 yrs tears ago.

The letter was very polite, with the usual the big red letters 'Demand for payment'

the letter was very vague, noted hsbc and the amount, which i know is only half the amount that I owe? My name on the letter was not correct, (first name and surname are fine but far too many middle initials).
I think in in to my 6th year, (i work it out to around 2003 since the last payment, I've never sent anything in writing to any compny, only ever called (but not since 2003). there has been a couple of letters over the years been forwarded on from my prvious address' but no one has called me or knocked at the door.

It is not the fact that I dont want to pay them back, but i'm in a dead end job, and my mum gives me £50 each month just to cover the out goings and these are just the essentials like gas electric and council tax.

can anyone shed any light on this, as i've now purchased a home so i cant just ignore thisd now.

Kind regards.

First you need to make sure that this debt is actually yours - especially if the intials are wrong.

I would send the 'prove it' letter. DCA's don't care about where they get the money from and it is not uncommon for them to chase people with the same name for a debt.

If you have made no payments towards a debt for 6 years (5 in Scotland) and not acknowledged the debt in writing, then the debt may be statute barred. You will need to be certain when the last time you made a payment was though.

Are you able to find out when you did last pay from cheque book stubs or bank statements?

I would send the prove it letter, http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2

And put this paragraph in bold at the top (before Dear Sir) I do not acknowledge any debt to you or any other company or organisation that you claim to be representing.

Whatever you do do not make a payment until you know whether it is statute barred. And if they should find a number for you and call you, don't enter a discussion ask them to put everything in writing to you.
