hello
i need some advice.im in £40,000 debt with 2 credit cards and a loan that i ran up years ago now,i havent used any credit for 2 years or more now.
I am a single mum of 2 a 2 year old and 1 year old and i am on benifits at the moment.
i want to go back to work but when i went to the job center they said i will be £20 worse of for working then claming benifits because they wont pay morgage or council tax and i will have to put my kids into full time nursery which i wouldnt want to do.
but to cut a long story short,i need to know if i can go bancrupt and keep my house.it is only a 2 bed bungalow and my morgage is interest only and i have a £10,000 fee to pay if i sell my hose before october an i owe £20,000 to my ex the deposit he payed.
i have had the house on the market for a year and it hasent sold.i owe £162,000 on the morgage so i would need at least 196,000 to be able to pay that and a bungalow the same as mine has just gone up for sale a couple of doors up for £175,000 so i dont stand a chance.
i was with a debt management company but now cannot afford that as my ex used to give me the money to pay it but now he has lost his job.my benifits only just cover essential bills.
i cant believe i am in such a finacial state,if only i could turn back time.
anyway can anyone help me answer my question,could i keep my house and go bancrupt?
i really dont want to lose the roof over my kids head and confuse things for them even more

you MUST seek PROPER advice from CCCS, national debtline or the CAB
you have to decide, do you want to keep the house?
do you want to be debt free
are there any secured debts you owe?
is there any charging order on the house?
are you in england/wales or scotland or N.I.?

and yes, its possible you could retain the house if you go bankrupt0
