                    Hi all.
My partner & i have been seeing the helpful people at CAB about debts, and going Br.. and we have been offered another meeting with them , to sort the br forms etc, but not till September! I realise they are very busy right now, and many probably take priority over us.. but what about the increasing phone calls etc?
We were advised to stop paying creditors anything, and use it to live on and for the br charges.. so we opened a basic account away from the overdrafts, and hopefully this months wages will get paid into that- but I am getting tonnes of calls from Abbey about my old Ccard, and have now stored their number and let it go to answerphone.. so they sent me a letter, threatening court action, even though i have only missed one payment of £52!
The debt advisor from CAB told me to stick it out, as they can't do anything in a few weeks, and to just not answer the phone.. but what do i do if they continue with the court route? I feel worried about holding on till sept with letters like this landing on my doormat.
Advice anyone?
Many thanks

Hi, first of all DONT PANIC.
Secondly as the CAB it will take many months for any court action to materialise and you would receive proper notification, it wont just creep up on you. The first step would just be a ccj which just tells you that you deffinitally do owe the money which you already knew.
Thirdly, If you have already made the decision to go bankrupt, you can start filling in the forms yourself, ask as many questions on here that you need to. There are lots of people to helpHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

Hi Minxz - debtinfo is correct that it takes months for anything serious to happen. I stopped paying my bills 11 months before I went BR. If it is feasible, unplug your phone at 8:00 am and plug it back in at 9:00 pm. otherwise screen your calls and don't pick up. I know the phone calls are stressful but just remember it is only a phone call and they cannot do anything over the phone.
In the unlikely event that they come to your house - don't let them in. Just tell them to go away.
You don't have to wait for the CAB to fill in your forms get started on it now with the help of this forum. They are easy to do and we can all help you.

Hey minxz, i second that, i was nearly a year before going br, i had a wheely bin full of letter that i didnt open, i unplugged the phone. I couldnt beileve how many of the same threating letters i had from my creditors, i went BR 3 weeks ago and i still am getting the odd few, just makes me chuckle. If you owe Council Tax then its best not to ignore them in my opinion.
I filled in the forms online bymyself, there not too difficult but quite long, and if there is something your not sure of, you can be confident that someone on this board will help out as they have done me over the last 7 months.0

There are some debts you shouldn't ignore, such as council tax debts, utilities, and rent / mortgage. Pretty much everything else is hot air at this stage: any court action would cease the second you went BR.“The ideas of debtor and creditor as to what constitutes a good time never coincide.”

I would also suggest a DIY approach.
Post any questions here and you will get a reply within minutes/hours.0

The great thing about the online forms is that they tell you exactly how much you have completed as you go along. Save them regularly so if anything crashes you don't lose what you have done, and give yourself plenty of time for completing them.Get free advice before embarking on bankruptcy: CCCS 0800 138 1111 National Debtline 0808 808 4000

            Hi,
I echo everything said by others earlier. Right now, even before your BR, is the first time in months, probably years that YOU are in control of your debts instead of your debts controlling you.
You creditors have lost and are out of time. There is nothing they can do to you now even if they were very fast and gained a CCJ they cetainly have no time to enforce it.
Ignore the letters, unplug /put on answer machine the phone and enjoy the thought of a debt free life ahead of you.

wow i totally understand were your coming from, i only had a first visit to CAB a week and a half ago, but had stopped my DDs a month ago, so getting onto the 2nd month of missing payments, i have to take a form back to CAB on tuesday then they will take it from there, so i think it will a long hall before they get on with the BR forms IF thats what they sugest as i have had to put DHs full wage on it, and his loand and CC so its kind of messed up the figures for 'just me'.
Like you Abby, now Santander are calling numerous times a day, as are the TSB, i have 5 kids at home so turning phone off, not answering isnt going to work, nor would the not answering the door thing, which is a huge worry as my kids dont know wanything about our money troubles.
So i am a little concerned like you.

Thank you all for the replies
I can't switch the phone off, as i have an ill father, so I might miss an important call, but i have saved the numbers Abbey call from and when their name comes up i let it ring.
Answering the door is a worry, as i have kids who could answer it to someone i'd rather not see too!
