Mortgage or a CCA Regulated Loan - which one?

I took out a mortgage in 1989 for £180,000 with a High St bank.same day I was granted a further advance of £10,000 for ' home improvements' all documented separately from the mortgage. Should this have been a CCA regulated loan rather than being dumped (consolidated) into the mortgage? If so, can I ask for it back as it has not been executed correctly?

Before anyone thinks I'm just trying to get out of something, just imagine this was going to repossession and I wanted to put up a defence to what the bank was asking for.

My overall question is much deeper than the question being asked, I just need to know how a further advance on the same day should be documented and regulated, CCA or Mortgage.
