I have had a letter from a company called dlc who are acting for ge money who i had my mortgage with.I have been br since october and my house was re-po and sold off which was all listed as secured creditors on my br forms.I gave dlc my br ref number and details of the OR however they have rang me back this morning to tell me that they spoke to the OR yesterday an this shortfall is not included in my BR and that I have to pay them 50 grand immediately.I am stressed again now as the OR not open till monday and I do not know why they would say this cos it was definately listed on my forms.

They might be trying it on. I guess you wont know til you speak to the OR on Monday.
Someone will be along with better advice than that in a minute...Look down your nose at me and I thumb my nose back at you.

Try not to panic as i expect they have called you on purpose on a saturday to make you worry and i bet they are trying to pull a fast one. Someone i am sure will be along soon who will know for sure.:cheesy: K2nga :cheesy:

Try not to worry yourself - I am almost 100% certain that they are just trying it on (and putting the fear of God into you the process - pigs). If you are sure it's on your forms (do you have a copy? you should) then rest easy.
Also, one of the reasons that BR is published in your own and the London press is for any creditors who may not have been listed to be made aware and contact the OR at that point - their loss.
Stay calm if you can.
ETA - if they call again, and you choose to speak to them, refer them again to the OR and inform that to pay them is impossible as it would be favouring a creditor which is "illegal" (not sure of the correct word for that, frowned on doesn't have the same impact does it....... ).

I have just had some real problems with DLC. Five months after my BR they started calling 2 or 3 times a day. I must have told them my BR details 3 times and still they kept calling. Last Saturday on getting another call I asked to speak to a manager there who sorted it out and no more calls.
I can't give you a definitive answer as to your dilemma, I would suspect it is a try on. Get on to the OR on Monday first thing, until then try and relax... easier said than done, I know.

Your legal liability for any future shortfall was incurred before the bankruptcy, and as such is a liability that is written off in the bankruptcy once the property is sold. Even after BR.

Quite right.
Also it does not matter whether you mentioned the shortfall on the BR forms or not, all pre BR debts are written off whether on the forms or not.
I asume that you never signed anything after BR regarding the shortfall, and make sure you NEVER sign anything now.

I would most definitely report them as I don't think they are acting strictly within the law. Try not to worry for the rest of the weekend it is almost certain the shortfall is included in your BR. I wouldn't answer any more of their phone calls - refuse to go through their security questions or don't answer the phone.
