Csa arrears, help!!!!!!!! Please!!

Ok so here goes,
CSA rang me up today, saying that I owe £4850 for arrears dated from Oct 2007 to early part of 2009, they worked it out as to £72 per week. I have been in constant talks and discussions with them for future maintenance to which im paying and have been since Feb 2009, this is £61 per week (I am ok with this as I beleive in child maintenance - afterall it is for my son) BUT they have said that my arrears (an extra £72 p/w) is to be paid on top of my current maintenance of (£61 p/w) making it (if my maths is correct) £133 p/w... thats £532 per month... I mentioned to them that I think the arrears is not as much as they said it was (by somewhat £1500) but she just came back with the attitude of not giving a damn and that the figure is SET!!! then she said 'We will create a Deduction of earnings of 40% if we do not have a payment plan worked out'.. There payment plan is non-negotiable, either I pay a lump some of £2000 today and pay the rest off monthly OR pay the £72 extra per week until paid off OR they will take the 40% from my earnings....
I mentioned either way I am genuinely unable to afford that, and I can only afford to pay an extra £40 per month until its complete (or I come into money). They then came back with 'there is a 2 year legislation meaning that you MUST pay all arrears off within the 2years' (IS THIS TRUE??????)...
Is there a Protection of earnings???????
I am willing to co-operate with the CSA (even if I think there calculations are wrong) but it seems to me they are happy to BULLY the NRP's who are willing to pay for there childs upkeep, NO MATTER WHAT...
Any help or guidance will be very much appreciated

They are trying to scare you.. Problem lies a little with if they have a DEO on you, where they can take a big chunk in terms of percentage of your wages. No legal requirment that they need to take the money off you in two years. Thats used as a scare tactic, they rely on you not knowing the rules and clever terms and words are used to frighten you.
Agree, what you can within reason ( don't be ridiculous like a very small amount), reverse it by asking for CSA standing order details (they can be found), they won't have a leg to stand on if you pay regularly if they wish to take it further.
Remember do not be intimidated by them and stand your ground.
PS just saw they have a DEO, so you will probably need some advice and NACSA are very good.0 -
The 2 years is a guide line and not set in stone...if you feel the figures are wrong you really need to take this up.0

Please also remember to write to them via recorded delivery, and have a paper file with names, dates, times of all if any phone conversations(these are not recommended). Involve your MP but some are more useful than others, Labour expenses etc etc seem less helpful than the opposition.
Blimey is right, ask NACSA for help, and also with regard to chasing arrears from CS2 cases I also heard the same, but think might have been Blob with regard to House Of Common debate recently.0 -
Don't forget that even if they threaten to deo you for 40% of your net income, you must be left with your protected earnings figure by your employer. Sometimes your protected earnings figure will be more than 60% of your net income, especially if you have a partner and children in your household.0

I'm having to re morgtage my home to pay off £18,000 of arrears.
I had £435 to pay each month which i told the csa it would leave me in a position where i would have more going out than coming in. The usual i'm not bothered sprang to mind when talking to these people.
i re morgtage to protect my house basically.
I'm still going to fight the decision when i pay them the arrears off.0 -
