Is it possible?..

I separated from my husband in March. The house is mortgaged in joint names.. currently it isn't being paid.

I haven't had any money from XH this month as he has moved into a house and I can't actually be bothered to nag him.. this won't be happening again.

According to the CSA website he should be paying me £430ish a month maintenance for the children.. This would mean I have around £1500 a month coming in.. with this much income I can just about afford the mortgage payments.. BUT could I remortgage the house just in my name (assuming he is agreeable.. I'll not hold my breath!) I will be paying the mortgage out of this money anyway but it is the fact that he can just suddenly decide to move back in and there is nothing I can do about it which I am not happy with at all!

I am Starting at uni in September.. I know this will change the amount of income I get but it shouldn't be too radically different..

    If the mortgage company dont think you can afford the mortgage in your name then they can insist that he is kept on the deeds as well

    I know but the fact he doesn't want to be on it should be taken into account shouldn't it?

    Is it possible to get a remortgage on benefits or student bursary alone?

    You won't get a mortgage on benefits and bursary alone, especially as you say that the mortgage isn't currently being paid.

    If the CSA get involved they may get money out of your husband but I wouldn't bank on it being a quick process, I have friends that have had a nightmare.

    If your mortgage is not being paid are you speaking to the lender to try to negotiate some sort of arrangement? How many months in arrears?

    They won't take the fact that he doesn't want to be on it into account - he signed up for the mortgage and can't back out of it just by saying he wants to. The lender have to be happy that the mortgage is affordable to you. Is there much equity in the house? Is selling up and renting an option?
