need help with equita and bailiffs

if anybody could help pe i would be very greatfull as this matter is causing me a lot of worrie and distress

i got given a parking ticket about a year ago and paid it late i didnt realise this through my own stupidity at the time so thought no more of it, at the time i was living with my girlfriend and son our relationship brokedown and me and my son had to leave we became homless for over 6 months staying with friends and family in this time i never thought to cahnge the details of my car with the dvla as i had nowhere to put them to anyways to cut a long storie short myself and my son moved in to a new home a few months ago i then got made redundant :(

two weeks ago i came out of my house to find a notice stuck to my car window saying that equita where going to remove my car or take my posessions i rang the bailiff to ask what was going on and was told i had to pay £350 by the end of the month or they would take my car i agreed but do not have the money and i have 7 days left to pay i dont know what to do as i have never been in this situation and feel quite intimerdated by them any replys or help would be greatfull thankyou

    There was a programme on BBC about parking & Bailiffs.
    One guy got a parking ticket & when the guy answered the door the bailiff told him they are taking the car if he did not pay.
    Guy told the bailiff that he had sold the car & the paperwork was probably in the system, Admitted on camera that he did the sneaky deed put car in wifes name to avoid paying.

    If it is not yours they cannot take it.
  • thanks for the reply but am more concerned about my rights do i have to pay £350 for a £40 pound fine as i have received no letters or visits as they where going to the wrong addresse i want to clear the debt but dont want to be taken for a ride by some scumbag company

    You need to send a pm to Herbie21 who runs the bailiff advice line. www.bailiffadviceonline.co.uk

    Unfortunately since the bailiff has done a levy on the car, he can charge for that.

    However, in the circumstances you may be able to go back to the court and get the bailiffs removed from the case. You really do need someone like Herbie to help you with that. Her company does charge for letter templates and calls but she does a lot of work for people on here for free.


    In the mean-time WRITE to Equita or better still send an e-mail to:

    You need to say something along the following lines.

    I refer to the above account in relation to unpaid parking dine due to xxxx

    As you will be aware from your files this account has been assed to your bailiff Mr xxx to enforce.

    The query that I have is concerning the amount that your bailiff is now stating is due. As a matter of urgency can you please provide a full and detailed breakdown of the charges made by your bailiff.

    A good point which is of absolutely no use to someone after their car has been levied upon. Once the bailiff has levied upon an item (and assuming for the sake of finishing this conversation this month that the levy is valid) it is now essentially the property of the bailiff. The previous owner no longer has the right to either sell or give it away.

    Now if title was transferred before the bailiff arrived then you'd be quite right, but that isn't the case here presumably or the post would read "need help with bailiffs threatening to take something that isn't mine".

    RAS' advice is (as is very often the case when they post) the way forwards here.

    It is CLEAR that you need to file an Out of Time late Statutory Declaration with the Traffic Enforcement Centre in the morning on the basis that you had not received the Notice to Owner etc. Once filed this will FREEZE all bailiff action until such time as the matter has been considered by the Traffic Enforcement Centre. This will take approx 2 months.
