No Visits - just letter advising me that council had handed over the case to the sherriff officers - only got the visit yesterday - and I was at work so the charge was put throught the letterbox!
Yes on submission of the forms it could take just 5 days - however I need to time it so that I can take my wages out of the bank before they freeze the account as this is the money to help with my move to a new house!0 -
A wee update on Timescale
I received the notice form the Sheriff Officers on 12 June 2009 advising me that a summary warrant had been passed to them by the Council for collection. The summary warrant date was the 8 June.
(This is the letter that gives you a chance to enter into an agreement of payment with the sheriff officers). It also states that a summary warrant authorises recovery by;
· The service of a charge of payment by a Sheriff Officer who will visit your home
· An arrestment of your earnings and/or bank
· An attachment and auction of effects in accordance with Parts 2 and 3 of the debt Arrangement & Attachment Scotland act 2002
It also states ‘a charge for payment may be used to constitute your apparent insolvency which could lead to a Petition for your bankruptcy being lodge at court’.
I contacted them on the 26 June and made an arrangement to pay a sum on a weekly basis. I didn’t want them to arrest my wages or serve and attachment order for my possessions. I made one payment. Then I received a letter on 13th July stating that I must contact them as I hadn’t kept to the agreement. As I said they called round with the charge yesterday – 23 July. This was only to deliver the charge.
This charge is for outstanding arrears on this year 2009/2010 Council Tax. Just to let you know I do also have outstanding arrears from 2 previous years too! I have been paying intermittently when and what I could afford during the previous years – I have not until those 2 payments in early July paid anything to this years so far.
I think they have done me a huge favour!:o0 -
