Hi there I am hoping someone can help me, My husband and I had mortgage arears of £3567.00 and we were a month away fron reposession with four young children, so cap in hand I went to my parents who agreed to bail us out. I contactd the mortgage company and asked for final figure of arears, I paid junes payment in may and cleared off all the arears. I spoke to 3 operators regrding the arears and asked all "was that the final amount" to which they all replied "yes", when i cleared the debt the operator an I had a laugh about sleeping easy at night. I called again on the 30/6 to pay monthly payment (my due date for payment is 1st of the month) and was put through to litagation. How surprised was I when they told me I had arears of £527.51 and if I didnt pay that day they would go for repossesion, furious I spoke to a mgr who explain it was totally there fault I had been given the wrong figure ,if I hadnt payed junes payment early the operator would not of missed it and the computer would of calcualted ther arears different however I still need to pay!! After a huge debate I explaned I could not pay, they had my financial outgoings on record and told ME I could not afford to pay the arears that I would of could of and should of payed in may had they given me the correct figure. could someone please advised me on what to do , thank you.

They won't get a possession order for arrears of £527.51.
Have you been to court before?
Have you had a payment arrangement with them and not kept it?
Do you have the date and times of when you spoke to the operators that gave you the settlement figure.
Are you able to maintain the future mortgage payments

i am not an expert but i dont think they can go for repo for that amount, put a complaint in writing to them, it was their error not yours, good luck with this0

Might be worth asking about this on the debt free wannabe board - they have a lot of experience in dealing with this sort of question.
Hope it all goes well, it does sound awful!0
