Student Loan

Hello does anyone have any idea what i should do?
Background is my H2B job moved him to the states for 2 years i went with him I wasn't allowed to work there have just come back because we are getting married at home to find a letter from student loans saying where are you why you no pay? (not them words exactly but you know what i mean) and saying if abroad the basic pay rate is £425 a month and a fine of £150 for not saying i have moved.
Now i always left my mum and dads address for everything for me especially now because post isn't secure over there but my mum and dad moved house six weeks ago i was just gonna sort everything when i got back are they gonna fine me the £150?
As for the £450 i'm not working i can't on the visa i have so how am i gonna pay? they also say i have to prove my finacial position - how do you prove your not working?
Any help will be appreciated

    If they're entitled to "fine" you the £150 then yes they probably will. Check your terms for the loan.

    As for the rest of it, perhaps showing them a copy of the visa saying you're not allowed to work would suffice as proof that you're not working. Other than that, it's your responsibility to ensure you manage your finances. It isn't the fault or the problem of the loan company that you chose to go abroad and not service the debt. Perhaps your other half can help - surely if you're living as a couple you plan your finances as a couple and took this debt into account when deciding what to do?

    Sorry if that sounds unsympathetic. It's not that I find your plight here amusing, just that, well, you've got to make an effort to help yourself and you're giving the impression that you swanned off abroad without thinking about things like this and it would just be ok somehow.

    I imagine they did what I would have done when considering my wife's loan. If she's not working, the terms of the loan say it's only payable if she is working, therefore, it's not a debt that needs to be considered as a cost on joint finances.

    OP, unfortuntely you should have checked what happens when you're overseas. I believe you shouldn't have had to pay the loan, but there was some paperwork to do. If they consider you in arrears, they might consider that you have broken the agreement. There's information here:

    It is not enough to show that your not working and no visa. YOu would need a letter from your husband stating that he is supporting you as your are not able to work due to visa regulations. Student Loans use the £150 fine and £425 per month repayment as a threat to find otu where you are since you have disappeared from the tax system and failed to advise them you were going overseas.

    It is the responsibility of the borrowers (ie you) to inform Student Loans of any changes to address or moving abroad or returning.

    Fill the form in with the letter from your husband and it should be good.
  • It is true that you are responsible for your own correspondence address. also student loans are not covered by normal credit laws. Even if you go bankrupt you are still liable for the debt.
  • If you start getting into problems, i suggest you look into the freeman concept and common law.
